हरियाणा के सामाजिक न्याय एवं अधिकारिता राज्य मंत्री श्री कृष्ण कुमार बेदी ने कहा है कि प्रधानमंत्री श्री नरेन्द्र मोदी की दिव्यांगों के संवेदनशीलता के प्रति ही दिव्यांग अधिकार अधिनियम, 2016 के तहत दिव्यांग श्रेणियों की संख्या सात से बढ़ाकर 21 की गई है। हरियाणा में शीघ्र की दिव्यांग नियम, 2017 के क्रियान्वयन के लिए राज्य स्तरीय सलाहकार बोर्ड का गठन किया जाएगा।

श्री बेदी आज हरियाणा सामाजिक न्याय एवं अधिकारिता विभाग तथा पंजाब विश्वविद्यालय चण्डीगढ़ के सामाजिक कार्य विभाग के सहयोग से विश्वविद्यालय के गोल्डन जुबली कॉन्फ्रेंस हॉल में आयोजित राज्य स्तरीय कार्यशाला में मुख्य अतिथि के रूप में बोल रहे थे।
श्री बेदी ने दिव्यंागजनों को प्रोत्साहित करने के लिए सर्वश्रेष्ठ दिव्यांग कर्मचारी, स्व रोजगार चलाने वाले दिव्यांगो के नियोक्ता एवं दिव्यांग व्यक्तियों के प्लैसमेंट अधिकारी व एजेंसी, व्यक्ति संस्था, सृजनशील दिव्यांग एवं खिलाड़ी को प्रतिवर्ष दी जा रही 10 हजार से 50 हजार रुपये की पुरस्कार राशि में बढ़ोतरी करने के निर्देश में उपस्थित अधिकारियोंं को दिए। उन्होंने बताया कि दिव्यांग दोस्ताना वैबसाइट डिजाइन करने के लिए हरियाणा में 69 विभागों की पहचान की गई जिनमें 30 विभागें ने अपनी वैबसाईट शुरू की जा चुकी है।

श्री बेदी ने इस कार्यशाला के आयोजन की पहल करने के लिए विभाग के प्रधान सचिव श्रीमती नीरजा शेखर व निदेेशक श्रीमती गौरी प्राशर जोशी तथा सहयोग के लिए विश्वविद्यालय के समाजिक कार्य विभाग की चैयरयपर्सन श्रीमती मोनिका मुंजाल व अन्य संकाय सदस्यों का आभार व्यक्त किया।

उन्होंने बताया की हरियाणा के मुख्यमंत्री श्री मनोहर लाल दिव्यांगजनों के प्रति संवेदनशील है और उन्हीं के प्रयासों के फलस्वरूप करनाल में मूक, बधिर व नेत्रहीन व्यक्त्यिों के लिए महाविद्यालय स्तर के एक संस्थान केन्द्र सरकार के माध्यम से खोली जा रही है जिसके लिए हरियाणा सरकार जमीन उपलब्ध करवाएगी जो पानीपत में अंध विद्यालय का दर्जा बढ़ाएंगे।

विभिन्न विभागों ,गैर सरकारी संगठनो, विशिष्टï दिव्यांगजनों व अन्य स्टेक हाल्र्डस का कार्यशाला में भाग लेने के लिए मंत्री ने कहा कि दिनभर चलने वाले इस चिंतन मंथन शिविर से निश्चित रूप से दिव्यांगजनों के शिक्षा, स्वास्थ्य, सामाजिक एव आर्थिक सामनता के सुझाव उभरकर आएंगे जो दिव्यांगजन अधिनियम,2016 के कार्यान्वयन में राज्य सरकार के लिए नियम बनाने में कारगर व महत्वपूर्ण सिद्घ होंगे।

श्री बेदी ने हरियाणा में दिव्यांगजनों के लिए चलाई जा रही विभिन्न योजनाओं व कार्यक्रमों की जानकारी पर भी विस्तार से प्रकाश डाला। उन्होंने कहा कि सामाजिक न्याय एवं अधिकारिता विभाग के वर्ष 2018-19 के कुल 6077 करोड़ रुपये के आवंटन बजट में दिव्यांगजनों के कल्याण हेतु 412.67 करोड़ रुपये का प्रावधान किया गया है।

उन्होंने कहा कि वर्ष 2011 की जनगणना के अनुसार राज्य में दिव्यांगजनों की कुल संख्या 5,46,374 है। जिनमें 1,37,314 मूक एवं बधिर, 82,702 दृष्टिïबाधित, 1,16,026 अस्थिबाधित, 30,070 मन्दबुद्घि, 16191 मानसिक रूप से बीमार, 47250 बहुदिव्यांगता व अन्य दिव्यंगता की संख्या 1,16,821 है।

श्री बेदी ने बताया कि हरियाणा में दिव्यांग व्यक्तियों के लिए चलाई जा रही पें’शन योजना के तहत 1,54000 पात्र व्यक्तियों को लाभ दिया जा रहा है। नवम्बर,2017 से इन्हें 18 हजार रुपये मासिक पेेशन दी जा रही है जबकि नवम्बर, 2018 सेें इसमें 200 रुपये की वृद्घि कर 2000 रुपये मासिक किया जाएगा। चालू वित्त वर्ष के दौरान इसके लिए 356.28 करोड़ रुपये का प्रावधान किया गया है।

Helmets have been made mandatory for women two-wheeler riders barring those who wear a turban.

Punjab governor and Chandigarh administrator VP Singh Badnore on Friday issued a notification that exempts only turbaned Sikh women from wearing a helmet while riding two-wheelers in Chandigarh. The order comes into immediate effect.

The decision had been pending since May when the Chandigarh administration had received 14 suggestions, of which seven were in favour of exempting only Sikh women, while the rest were against it. Senior UT officers sent their recommendations to the administrator for a decision.

On April 21, following the directions of the Punjab and Haryana high court, the Chandigarh administration had proposed that all women, except those who were Sikh and wore turbans, will have to wear helmets.

Proposing amendment in Rule 193 of the Chandigarh Motor Vehicle Rules, 1990, the UT had invited objections and suggestions from people within 30 days, from the date of publication of the draft notification in the extraordinary gazette.

The Chandigarh administration had proposed the amendment considering the safety of women, including that of Sikh women who did not wear a turban, particularly in view of the fatalities occurring in road accidents.

In his objection, Hardeep Singh Buterla, president of the Shiromani Akali Dal (SAD), said, “Women wearing helmet is totally against Sikhism. Amending the Chandigarh Motor Vehicle Rules, 1990, will hurt sentiments of Sikhs. We will not allow this to happen.”

On the other hand, RK Garg, president, Second Innings Association, said, “Wearing helmets is mandated for all those riding two-wheelers, but the state government is competent to make relaxation for some categories of two-wheeler riders. In view the high fatality rate of two-wheeler riders, including women, it is the need of the hour that for saving precious lives of all two-wheeler riders, wearing headgear may be made compulsory, as in case of accidents it is not the religion but the life that is the most important.”

Damanpreet Kaur of Teja Singh Sutantar Memorial Senior Secondary School was ranked 19 in merit list of sports students. After re-evaluation, her marks have been revised from 429/450 to 450/450.


In a shocker from Punjab School Education Board (PSEB), a Ludhiana girl who applied for re-evaluation in two subjects is now the state topper in class 12 exams (sports category), results of which were announced on April 23. Damanpreet Kaur of Teja Singh Sutantar Memorial Senior Secondary School was ranked 19 in the merit list of sports students. After re-evaluation, her marks have been revised from 429/450 to 450/450.Thus she is the third student now scoring 100 per cent marks in the sports category. Earlier Prachi Gaur and Pushwinder Kaur, both from Ludhiana scored 100 per cent in humanities and topped the state in the sports category.

Damanpreet Kaur had filed revaluation for sociology and Punjabi subjects but she has been given full marks in all subjects. She had earlier scored 92/100 in sociology, 68/75 in Punjabi, 74/75 in English, 98/100 in History and 97/100 in Physical education.

A softball player, she said, “I filed revaluation for Sociology and Punjabi as I was not satisfied with the marks. I was confident of securing a state rank. However, the result was a disappointment for me. Now the fresh marks prove that there was a goof up earlier.”

This year, a total of 3,18,834 students had registered for the plus-two exam and about 80,000 had to re-appear in both the classes.

The Supreme Court upheld the Chief Justice of India’s role as “Master of Roster”. Justices Sikri and Bhushan delivered two separate but concurring judgements upholding the prerogative of the CJI in the allocation of cases.


The Supreme Court Friday upheld the Chief Justice of India’s role as “Master of Roster”. A two-judge bench, comprising Justices A K Sikri and Ashok Bhushan, stated that the CJI’s role cannot be interpreted to include the Collegium when it comes to the allocation for cases as it will make day-to-day functioning difficult.

Disposing of the petition filed by senior advocate Shanti Bhushan, Justice A K Sikri said, “Erosion of respect for the Judiciary in public minds is the greatest threat to the independence of the institution.”

Justices Sikri and Bhushan delivered two separate but concurring judgements upholding the prerogative of the CJI in allocating cases.

Reacting to the verdict, advocate Prashant Bhushan, who represented Shanti Bhushan in court, tweeted, “Sad that SC today ruled that CJI can unilaterally decide allocation of cases. 4 judges pointed out in PC that CJI was abusing his powers in allotting sensitive cases like Loya’s, medical college scam etc. Unfortunate that SC has not insulated itself from abuse of CJI’s powers.”

In his petition, Shanti Bhushan had questioned the CJI as the ‘Master of Roster’ and wanted either the Collegium or a full court to decide the allocation of cases.

Attorney General K K Venugopal, in response to the plea, had argued that the role “requires decision on several aspects and that is not something that five (the Collegium) or all of them (judges) can sit and thrash it out”. He also told the court that “this is not like the appointment of judges… where the judges (of the Collegium) are not personally involved (they decide on the files of others). Here, they are personally involved, and each may want to hear cases of a particular jurisdiction”.

To this, Prashant Bhushan countered that it was safer to have a collective decision as the CJI, too, could want to hear cases of a particular jurisdiction.

In January this year, four senior-most judges — Justices J Chelameswar (since retired), Ranjan Gogoi, Madan B Lokur and Kurian Joseph — of the Supreme Court, in an unprecedented press conference, said that the situation in the apex court was “not in order” and many “less than desirable” things had taken place.

Haryana Employees need not to go under any test(Dope) : Vij

 

Haryana Health Minister Anil Vij today said that there was no proposal under consideration to order mandatory dope test of all government employees as has been done by neighbouring Punjab.

“No such proposal is under consideration in Haryana,” Vij told reporters this evening when asked about Punjab’s move.

Yesterday, Pujab Chief MinisterAmrinder Singh had ordered mandatory dope test of all government employees, including police personnel, from the time of their recruitment through every stage of their service.

When asked if there was any proposal to enact a tough law against drug peddlers, Vij said, “If we have to frame a tough law, we will frame that, we will not allow Haryana to fall into this (drug menace) trap.”

Replying to another question, Vij said some jail inmates have been found to be HIV positive when their health screening was done recently.

“We carried out health check up of all jail inmates and some of them have been found to be suffering from HIV. Their total number if being verified. We have directed department to extend treatment facility and all other necessary help to them,” he said.

To another question pertaining to some doctors posted in the Kalpana Chawla Medical college in Karnal, he said, “We have got some reports that some doctors there refer patients to private hospitals and even operate them there.”

“We give our doctors non-practicing allowance too. If they are found indulging in this illegal practice, then appropriate action will be taken against them,” Vij said.

A private hospital in Shamli was sealed and a case registered against three people after a video widely shared on social media allegedly showed the unqualified hospital owner performing a surgery.The order to seal the Aryan Hospital was issued by Chief Medical Officer (CMO) Raj Kumar Sharma on Wednesday. A case has been registered at the Adarsh Nagar police station against Nar Dev alias Arjun, the owner of the hospital, a doctor identified as Shamshad Anwar and nurse Renu. The nurse was allegedly seen in the video administering anaesthesia to a patient in the operating theatre.

The case was registered on the directions of the CMO, who confirmed that the hospital has been sealed and an FIR lodged. He said that the registration of the hospital will be cancelled soon.

The hospital had been sealed once before for operating without registration. It was allowed to operate after it got itself registered.

Assuring stern action against the culprits, the CMO claimed that half of all the surgeries in the district were being performed in the hospital.

A video shared on social media two days ago allegedly showed the owner of the hospital performing a surgery in the absence of a qualified surgeon.

Taking cognisance of the video, the CMO sent a team of health department officials headed by an Additional CMO rank officer on Tuesday to inquire about the issue and gave two days time to the hospital authorities to furnish their reply.

“The decision to seal the hospital was taken on Wednesday when we did not get any reply from them,” said the CMO.

He said that the main accused worked as a compounder in a hospital for a few years where he obtained some knowledge of surgery and treatments.“He then opened his own hospital in the city six years ago and appointed surgeons and qualified doctors for few days in order to dodge the health department,” said the CMO.

Arvind Kejriwal fails to discern fine print of SC verdict, chooses conflict over conciliation

In their over-enthusiasm to claim victory, Delhi chief minister Arvind Kejriwal and rest of Aam Aadmi Party (AAP) leadership failed to discern the fine print of Supreme Court (SC) verdict.

The tweets fired off by two top AAP leaders Manish Sisodia and Saurabh Bharadwaj just minutes after the verdict indicated the Kejriwal government had begun searching for fresh avenues of conflict rather than working out a more conciliatory path of coordination (as advised by the apex court).

Deputy Chief Minister Sisodia stressed that “elected government would now be free to do transfer and postings of officials” and files need not be sent to Lieutenant Governor Anil Baijal. Bharadwaj, the party spokesman, eagerly expressed the party and government’s wish for the Anti-Corruption Branch (ACB) to be brought under control of Kejriwal government.

The ACB is staffed by Delhi Police personnel and headed any an Additional Commissioner of Police-rank officer. It has the power to register FIRs, investigate, arrest and prosecute. Control over ACB gives Kejriwal the power to police (albeit indirectly). It should be noted that in the national capital, police, public order and land is under the ambit of the Centre and the same has been reiterated by Supreme Court order on Wednesday. Further reasons for conflict over control of ACB and why Kejriwal government can’t have it will be analysed a bit later.

The hurry to have absolute discretion on transfer-posting of officials and employees of all grades — Indian Administrative Service (IAS) to peons — and let all concerned know about it indicates the keenness of the AAP and Kejriwal government to tame permanent bureaucracy and subordinate staff. Power to transfer and post have been most important tools in the hands of political leadership to make both individual bureaucrats and bureaucracy at large toe their line (right or wrong).

Kejriwal government’s desire to make bureaucracy work as per their whims has been at the root of alleged manhandling of Chief Secretary Anshu Prakash in the presence of Kejriwal and Sisodia and subsequently at “sofa dharna” which Kejriwal staged with three of his ministerial colleagues at Raj Niwas.

True to Sisodia’s words, the very first decisions taken by Kejriwal government was thrusting upon themselves the power to transfer IAS, Delhi, Andaman and Nicobar Islands Civil Service (DANICS), Delhi Subordinate Services Selection Board (DASS) and other officials as and when Kejriwal and ministerial colleagues deemed fit.

The subsequent response by the bureaucracy proved Kejriwal and the rest of political leadership grossly underestimated the power and resoluteness of the former to go by the book. An order by deputy chief minister of half-a-state/Union Territory with regard to assuming absolute powers to transfer top babus to subordinate staff could not override a Presidential notification (21 May, 2015), which entrusted L-G, chief secretary and secretary services with the task.

Kejriwal and his team argue that beyond police, public order and law, all other powers rest with elected government but they don’t care to read other part of the ruling, which said, “The status of NCT of Delhi is sui generis, a class apart”… and other parts reaffirming it is not a full State and can’t be a full State under present constitutional scheme and is a Union Territory (UT).

“Services” is listed in state list but as per the interpretations of Union home ministry since Delhi is not a state but a UT, power to command services is not vested with city government. SC ruling also said Delhi is a UT. IAS officers posted here are UT or AGMUT (Arunachal Pradesh, Goa, Mizoram and Union Territory) cadre. DANICS officials are of Delhi and Andaman and Nicobar Island Civil Services cadre.

It is thus taken that it is beyond purview of Delhi government (Kejriwal) to transfer and post their as per its likes or dislikes. For 15 years, Sheila Diskhit — and Sahib Singh Verma or Madan Lal Khurana before her — didn’t have much of a problem with the system because they all worked in coordination with the LGs. Kejriwal, however, chose a confrontationist path and the results are there for everyone to see: Making the people of Delhi suffer.

Union minister Arun Jaitley, who besides being born and brought up in Delhi, has closely studied constitutional provisions and law. He wrote in his blog: “The Supreme Court has held categorically that Delhi cannot compare itself at par with other states and, therefore, any presumption that the administration of the UT cadre of services has been decided in favour of the Delhi government would be wholly erroneous.”

Kejriwal and his colleagues clearly have other ideas. The issue, in all likelihood, will go to the SC. Until then, Delhi will see a stalemate between Kejriwal and L-G-bureaucracy. As for control over ACB, Jaitley’s argument is logical (albeit without naming it) when he said, “If Delhi has no police powers, it cannot set up investigative agency to investigate crimes as had been done in the past.”

It may be recalled on 11 February, 2014, in his first short-lived stint as Delhi chief minister, Kejriwal ordered an FIR be filed against two Union ministers and a leading industrialist, leading the Ministry of Home Affairs to clearly define ACB’s domain and who controls it.
