NC, PDP and now Congress will bycott polls tomorrow


The Congress is reported to have received suggestions to not boycott the elections as such a step would provide a clear field to the BJP to sweep the polls in the absence of any strong candidates against them


With the National Conference (NC) and the PDP announcing to boycott the coming panchayats and urban local body polls in Jammu and Kashmir, the Congress has convened a meeting of party legislators and senior leaders in Srinagar on Tuesday to decide its stand on the issue. The Congress is reported to have received suggestions against poll boycott as such a step would provide a clear field to the BJP to sweep the polls in the absence of any strong candidates against them.

When contacted, Pradesh Congress Committee chief GA Mir said any decision on boycott would be taken on the basis of consensus in Tuesday’s meeting.

He, however, said the atmosphere was not conducive for holding these elections and the party had brought this to the notice of Governor Satya Pal Malik. The PCC wants that safety of the candidates and electorate should first be ensured before holding these elections.

Mir expressed surprise over the stand taken by the NC and the PDP to boycott the polls. If the NC was so serious about Article 35A then why did the party participate in the recent LAHDC elections in Kargil and Leh. “Mehbooba Mufti should have quit the coalition at the time allegations of the BJP backing an NGO that filed the petition against the Article 35A came to the fore,” Mir said.

After NC it is PDP to boycott Urban Local Bodies and panchayat polls

 

Mufti’s announcement comes days after the National Conference (NC) chief and MP Farooq Abdullah had announced that his party would contest all elections in the state until the centre cleared its stand on the Article 35-A.


Putting to uncertainty the upcoming rural polls in Jammu and Kashmir, the PDP chief and former Chief Minister Mehbooba Mufti on Monday announced that her party will boycott the panchayats and urban local body elections later this year and “will go to any extent to protect the Article 35-A against which petitions are being heard in the Supreme Court”.

Mufti’s announcement comes days after the National Conference (NC) chief and MP Farooq Abdullah had announced that his party would contest all elections in the state until the centre cleared its stand on the Article 35-A.

The boycott of the two main political parties of Kashmir is likely to throw the already delayed panchayat poll process in limbo. Their decision has comes after the Hurriyat leadership called for boycott of these elections.

On the other hand, it is learnt that the Governor Satya Pal Malik was firm on holding these elections and was consulting legal experts on also holding the local body and municipal corporation elections on non-party basis.

When asked whether the PDP would follow the NC that has decided to boycott also the assembly and Lok Sabha elections, Mehbooba told media persons that the boycott of PDP was only for the panchayats and urban local body polls.

She said the people of the state have “sacrificed a lot” and no one can fiddle with the validity of Article 35-A. “We don’t want any casualties or bloodshed” during elections under such tense atmosphere.

The PDP’s decision was announced by her after a meeting of the party legislators and senior leaders.

She said that during deliberations on the issue “it was noted with concern that the situation created by linking local bodies elections with the case pending in the Supreme Court about the Article 35-A has created serious apprehensions in the minds of people who genuinely see it as assault on the special constitutional position of the state”.

“The party feels that while the special position of the state is a matter of survival for its people and society, democratic system is its sustenance. It was felt that any attempt to impose any electoral exercise in the current atmosphere of fear and apprehension would seriously erode the credibility of the process and institutions,” she said.

“The party, therefore, urges the Government to review its decision to hold local bodies elections at this venture against the will of the people and instead focus on confidence building measures so that the state is assured of the inviolability of the constitutional guarantees that make it a special part of the Union of India”, she added.

Mehbooba said that as chief minister she had in a stern warning told the BJP and Prime Minister Narendra Modi that she would pull out of the alliance if any fiddling was done with Article 35-A by changing even any comma or fullstop, under any pretext, including property rights of widows or refugees will not be tolerated.

She said that she warned the Centre that no mainstream party would be there to carry the Indian flag in the Valley if fiddling with the constitutional provision goes on unabated. Mehbooba said that the constitutional position was the only bridge between rest of India and Kashmir and if it is eroded then the accession of the state would come into question.

Article 35-A, which gives special rights to people in the state and bars outsiders from owning immovable property, has been challenged in the Supreme Court. In August, the top court deferred the case till January 2019.

She confirmed that the Governor had visited her but only pleasantries were discussed over a cup of tea.

Students protest against ‘dress code’ notice at PU girls hostel

Chandigarh: September 9, 2018: Students of Panjab University, Chandigarh, especially girls, lodged a strong protest against the “dress code notice” put up on the notice board of the Mata Gujri Girls Hostel 1 on PU campus. The notice had cited that girl students should be properly dressed while going to common room, dining hall and hostel functions failing which a fine would be imposed by the warden. This had irked students on the university campus.

On Sunday, SFS submitted a memorandum demanding that the notice be taken down. As part of the protest call, newly-elected PUCSC president Kanupriya met the hostellers following which, the warden removed the notice and addressed grievances mentioned in the memorandum. “Such rules represent a very derogatory mindset of the authorities. Moral policing has no place on Panjab University campus,” said Kanupriya. Former MP Pawan Kumar Bansal has also condemned the notice.

Farooq threatens to boycott local bodies, assembly and parliamentary elections


He said the Centre and the state government hurriedly announced the the ULB and panchayat polls.


Days after the National Conference announced its decision to not participate in the panchayat and urban local bodies (ULB) elections, the party on Saturday threatened to boycott the assembly and parliamentary polls too if the Centre does not take effective steps for protection of Article 35-A.

Article 35-A, which was incorporated in the Constitution by a 1954 Presidential Order, accords special rights and privileges to the citizens of Jammu & Kashmir and bars people from outside the state from acquiring any immovable property in the state. It is facing legal challenge in the Supreme Court.

“How can we go to our workers and ask them to come out to vote? First do justice to us and clear your (Centre) stand (on Article 35-A). If your plan is that (weakening Jammu and Kashmir’s special position), then our ways are separate. Then we cannot have elections. Not only these (urban local bodies and panchayat) polls, but we will also boycott the assembly and parliamentary elections then,” NC president Farooq Abdullah said in Srinagar.

He was addressing party workers at a function here to mark the 36th death anniversary of his father and NC founder Sheikh Mohammad Abdullah.

The former chief minister said his party was not running away from polls, but wanted the Centre to do justice with the people of Jammu and Kashmir first and take effective steps for the protection of the state’s special position.

“On one hand they (Centre) want to conduct polls here. On the other hand they want to revoke Article 35-A, Article 370 has been weakened and there are also attacks on the (Jammu and Kashmir) Constitution,” Mr. Abdullah said.

He said the Centre and the state government hurriedly announced the the ULB and panchayat polls, which will be held next month in four and eight phases respectively.

“First they should have talked to us. They should have called every leader that they plan to conduct polls and asked for our opinion. They did not. The prime minister, like Hitler, announced on 15 August from the Red Fort that elections will be held in Jammu and Kashmir,” he said.

The NC president also trained his guns at National Security Advisor (NSA) Ajit Doval over his statement that having a separate constitution for Jammu and Kashmir was probably an “aberration”.

“Their (Centre’s) intentions are not right. They never were. The NSA has said that a separate constitution for Jammu and Kashmir is an aberration. I want to tell him from this stage that if the constitution is an aberration, then this accession (of Jammu and Kashmir to India) is also an aberration,” he said.

“On one hand they tell us that we are their crown, but on the other hand they put that crown in their feet So, they have to think. They cannot control this state if they cause any further problems here. If they want this state together with the country, then they should stop what they are doing,” Mr. Abdullah said.

Gen Bajwa supports ‘Self Determination’ for J&K


Islamabad supports self-determination, Gen. Qamar Javed Bajwa says in the presence of Prime Minister Imran Khan during Defence and Martyrs Day ceremony.


Pakistan Army chief Gen. Qamar Javed Bajwa on Friday raked up the Kashmir issue and reaffirmed Islamabad’s support for “self-determination” in Jammu and Kashmir.

The Pakistan Army learnt a lot from the 1965 and 1971 wars with India and had made the country’s defence impregnable by developing nuclear weapons, he said at a Defence and Martyrs Day, organised to mark the anniversary of the 1965 war with India, at the Army headquarters in Rawalpindi.

The event was attended by Prime Minister Imran Khan.

Gen. Bajwa said Pakistan supported the people of Jammu and Kashmir in their “struggle for the right to self-determination”.

“We have learned a lot from the wars of 65 and 71. We were able to further strengthen our defence forces in the wake of these wars. Despite difficult economic times, we were able to become an atomic power. September 6, 1965, is an important day in the history of our nation,” he said, adding that Pakistani soldiers jumped into the fiery pits of warfare but did not let the country be harmed. “The bravery shown by our nation during the 1965 war serves as an important lesson and an inspiration to our youth even today.”

Won’t fight other people’s wars, says Khan

Mr. Khan said Pakistan would never fight any other country’s war in future and his government’s foreign policy would be in the best interest of the nation. “We will not become part of a war of any other country [in future]… Our foreign policy will be in the best interest of the nation,” he said, apparently referring to the country’s involvement in neighbouring Afghanistan.

Pakistan was the ally of the United States during the Cold War as it fought the American war with the erstwhile Soviet Union in Afghanistan.

Mr. Khan praised the armed forces for combating terrorism. “No other nation has fought the war on terror like the Pakistan Army.” The role of the security forces and intelligence agencies in making the country safer against all threats was unparalleled, he said.

Mr. Khan also talked about investing in human capital by sending children to schools and building hospitals and system of merit so that everyone is treated equally on the pattern of first Muslim state of Medina. “The government will bring meritocracy and transparency in all sectors by following the golden principles of state of Medina,” he said.

नेशनल कांफ्रेंस के अध्यक्ष फारूक अब्दुल्ला ने अनुच्छेद 35ए को लेकर एडिशनल सॉलिसिटर जनरल (एएसजी) की सुप्रीम कोर्ट में दी गई दलील की आलोचना की है. दरअसल सुप्रीम कोर्ट में एएसजी ने दलील दी थी कि संविधान के अनुच्छेद 35ए में ‘एक पहलू लिंग भेदभाव का भी है.’

दरअसल एएसजी ने सुनवाई के दौरान इस दलील पर सहमति व्यक्त की कि अनुच्छेद 35ए और कुछ खास पहलुओं पर बहस की आवश्यकता है. उन्होंने कहा, ‘इससे इनकार नहीं किया जा सकता है कि इसमें लिंग भेदभाव का एक पहलू है.’

अब्दुल्ला ने एक बयान में कहा कि जम्मू-कश्मीर सरकार की तरफ से कोर्ट के समक्ष अगर इस तरह का बयान दिया गया है. तो इस  से संकेत मिलता है कि अनुच्छेद 35-ए का पक्ष लेने और चुनौती को संविधान पीठ के पहले के फैसले के आधार पर खारिज करने की मांग करने के बदले राज्य सरकार ने कोर्ट के समक्ष लगभग स्वीकार कर लिया है कि अनुच्छेद 35-ए के कुछ हिस्से हटाने के लायक हैं.

महा-अधिवक्ता जम्मू कश्मीर के लोगों के हितों के संरक्षक हैं

उन्होंने चिंता जताई कि ऐसे संवेदनशील मुकदमे में जम्मू-कश्मीर के महा-अधिवक्ता को हाशिए पर डाल दिया गया है. जो जम्मू-कश्मीर के संविधान के तहत राज्य के अनोखे कानूनी इतिहास और संवैधानिक दर्जे से संबंधित है. अब्दुल्ला ने कहा कि महा-अधिवक्ता को राज्य के लिए नियुक्त किया गया है और वह राज्य के लोगों के हितों की रक्षा करने और उनका प्रतिनिधित्व करने के लिए बाध्य हैं. वह संवैधानिक अधिकारी हैं और सभी अदालतों के समक्ष जम्मू-कश्मीर के लोगों के हितों के संरक्षक हैं.

सुप्रीम कोर्ट ने अनुच्छेद 35ए की संवैधानिक वैधता को चुनौती देने वाली याचिकाओं पर महत्वपूर्ण सुनवाई शुक्रवार को अगले साल जनवरी तक स्थगित कर दी थी. यह अनुच्छेद जम्मू-कश्मीर के मूल निवासी को विशेष अधिकार प्रदान करता है.

Supreme Court defers hearing to January for Article 35A


Article 35A is a presidential order that defines “permanent residents of Jammu and Kashmir”, and bars non-locals from buying and owning land in the state.


The Supreme Court on Friday deferred the hearing on Article 35A in Jammu and Kashmir to the second week of January 2019. The court was hearing a clutch of petitions challenging the constitutional validity of Article 35A.

Article 35A is a presidential order that defines “permanent residents of Jammu and Kashmir”, and bars non-locals from buying and owning land in the state.

The Centre and the state government have urged the top court to hear the matter only after local body elections, scheduled to begin in September, are over.

The state government told the court that any hearing on the matter now would create law and order issues in the local body elections.

“Any debate and discussion on Article 35 A has direct repercussions on law and order in Jammu and Kashmir. Local body polls will be held in 8 phases. They would begin in September and continue till December,” the state told the bench.

The provisions of Article 35-A bars people, who are not permanent residents of J&K, from seeking employment, settling in the state, acquiring immovable properties or undertaking any trade or business.

Hizbul Mujahideen chief’s son Shakeel arrested in terror-funding case


The NIA alleged Shakeel used to receive funds through a US-based international wire transfer company from Aijaz Ahmed Bhat, another accused in the case.


The National Investigation Agency (NIA) on Thursday arrested Syed Shakeel Yousuf, son of globally wanted terrorist Syed Salahuddin, in connection with a 2011 terror funding case for allegedly receiving money from his father.

Syed Salahuddin is the supreme commander of Pakistan’s Muzaffarabad-based Hizbul Mujahideen.

Shakeel Yousuf was nabbed in a raid carried out by the NIA in the Rambagh area of Srinagar in Jammu and Kashmir.

Shakeel, working as a laboratory assistant at a prestigious government hospital at present, was picked up from Rambagh locality of Srinagar and placed under arrest, an NIA spokesman said in Delhi.

The spokesman said, “In an operation today morning, NIA team along with the police and CRPF arrested Shakeel in a terror funding case.”

He is the second son of Salahuddin who has been arrested by the NIA in connection with the case. Earlier in June this year, his another son, Shahid, who was working in the agricultural department of the Jammu and Kashmir government, was arrested in the same case.

“He works as a laboratory technician in Sher-e-Kashmir Institute of Medical Sciences (SKIMS) Soura. Earlier in June, the NIA arrested Syed Shahid Yousuf, another son of Syed Salahuddin. He was working with the Jammu and Kashmir agricultural department,” said an official.

The NIA alleged Shakeel used to receive funds through a US-based international wire transfer company from Aijaz Ahmed Bhat, another accused in the case who is absconding and based in Saudi Arabia

The agency alleged Shakeel was “one of several Indian contacts of Bhat” who had been in telephonic contact with him for receiving money transfer codes. The case, registered by the NIA in April 2011, relates to transfer of money from Pakistan to Jammu and Kashmir through hawala channels via Delhi, which the agency believed was used in funding terrorism and secessionist activities.

Terrorists kidnapped the son of a Policeman in Trall, Kashmir


Asif Ahmad Rather, an agriculture graduate, was abducted from his home; his mother has made an emotional appeal for his release in a video.


Masked terrorists barged into the house of a policeman in the Tral area of South Kashmir on Wednesday night and kidnapped his son Asif Ahmad Rather, an agriculture graduate.

In another incident, two terrorists were killed in a gunfight between security forces and terrorists that broke out on Thursday morning in the Hajin area of North Kashmir.

Reports said armed terrorists barged into the house of Rafiq Ahmad Rather, posted at the CID headquarters in Srinagar, and abducted his son from the Pinglish area of Tral in Pulwama district.

Police confirmed that some unidentified gunmen abducted the youth but his whereabouts were not known. In a passionate appeal in a video, mother of the abducted youth, Hameeda Begum, sought his release.

Meanwhile, two terrorists were killed in a gunfight between security forces and terrorists that broke out on Thursday morning in the Hajin area of North Kashmir. The police had earlier said one terrorist had been killed but during a search of the area found the body of another terrorist.

Security forces launched a cordon and search operation (CASO) following specific information about the presence of terrorists in the area. As the forces reached the suspected spot, the hiding terrorists indiscriminately opened fire triggering an encounter.

Bandipura DC Shahid Iqbal Chaudhary escaped an attack at him in the area on Wednesday evening. Miscreants attacked his cavalcade at Nadihal, after stone pelting at SK Bala, Chaudhary said. The official car in which the DC was travelling was badly damaged.

Earlier on Wednesday, while addressing a gathering in the terror-torn Hajin, Chaudhary said peace was prerequisite for development. “Our team will put extra efforts to deliver well,” he added.

Hajin has become a virtual haven for Pakistani terrorists who have for the past few months been inflicting brutality on residents of the area. At least eight persons in the area were beheaded by terrorists on the suspicion of being informers of the police. Terrorists have been threatening residents of the area with dire consequences if anyone informed the police about their presence.

Meanwhile, the service rifle of a constable has gone missing in Poonch district of Jammu. An inquiry has been ordered and a special investigation team formed to recover the missing rifle, said Senior Superintendent of Police Rajiv Pandey.

Terrorists after killing four policemen in Shopian of South Kashmir on Wednesday had fled with their automatic rifles.
