In a decision with important workplace implications, the Supreme Court has ruled that superiors cannot be held responsible for abetment if an employee, depressed because of a heavy workload at office, commits suicide. The SC said a superior officer assigning a load of work to an employee could not be assumed to be of a criminal bent of mind who intended to harass an employee or force him to end his life. It rejected the argument of the Aurangabad bench of the Bombay HC that the officer was culpable even if there was no direct abetment on the grounds that the conditions created could lead to unbearable mental tension.

Kishor Parashar, working in the Aurangabad office of the deputy director of education in Maharashtra government, committed suicide in August 2017. His wife filed a complaint with the police accusing her husband’s superior officer of abetting the suicide. She alleged the superior used to assign a heavy workload to Parashar, requiring him to work till late evening.

She said the senior called him for work at odd hours and also on holidays, stopped salary for a month and threatened to stop increment. She claimed her husband remained silent at home and the superior was responsible for his suicide. After the Aurangabad police registered an FIR, the senior officer moved the Aurangabad bench of the Bombay HC for quashing the FIR.

On January 23, the HC rejected the plea to quash the FIR. The HC had said, “The facts indicate that there was no direct abetment and the applicants cannot have any intention that the deceased should commit suicide. Even when the accused persons have no such intention, if they create a situation causing mental tension so as to drive the person to commit suicide, they can be said to be instigating the accused to commit suicide.”

When the superior officer appealed before the SC, the plea was opposed by the Maharashtra government’s standing counsel Nishant Katneswarkar. A bench of Arun Mishra and U U Lalit found the HC’s logic in roping in the superior officer on the charge of abetting suicide untenable. Justice Lalit, who authored the judgment, said, “It is true that if a situation is created deliberately so as to drive a person to commit suicide, there would be room for attracting Section 306 of the IPC (abetment to suicide). However, the facts on record in the present case are inadequate and insufficient (to reach that conclusion).” The bench quashed the FIR against the superior officer.

AMID THE ongoing controversy over Britain’s failure to include Indian students in the liberalised visa norms, no official from the Indian government has approached the British High Commission to India on the matter. This was stated by Sir Dominic Asquith, the British High Commissioner to India, in an interview.

“I tend not to talk about my exchanges with the government, but, on this occasion, I will say no, nobody has (approached me on the student visa issue),” he said. “The terms being offered to Indian students this year are no different from what they were last year. Last year, to our delight, we saw 30 per cent more students going to the UK.”

Highlighting the silence in India about the British post-graduate degrees not being recognised by Indian universities, he said: “I am surprised that no one talks about the 14,000 students who do Master’s in the UK and come back, and that qualification is not recognised in India. I find that a bit odd.”

Responding to a question on some individuals like Vijay Mallya, Lalit Modi and Nirav Modi, who are wanted by Indian agencies, finding shelter in the UK, the High Commissioner said: “These frauds were committed in India. We are not responsible for the fraud. We are dealing with the aftereffects of a fraud and we are serious about dealing with the aftereffects. Sometimes people seem to think that the fraudsters committed the fraud in the UK, which is not the case.”

“The idea that we are somehow carefree about this is utterly ludicrous. We have a judicial system that we are extremely proud of. It may seem a bit protracted to an Indian audience, though to be fair, they have a legal system which is quite protracted as well. But the scrupulous adherence to judicial process is part of our democracy,” he said, while refusing to go into the details of individual cases.

“The seriousness with which we address both the handling of the cases or charges that are set, speaks for itself,” he argued. “The Crown Prosecution Service which is handling the Mallya case has earned praise from the Indian authorities about how they are going about it. The courts are going scrupulously over it, the banks have taken the orders from the judges. The handling of the case cannot be faulted for the judicial process or in respect of the process.”

The High Commissioner also said that the trade and investment relationship between India and the UK remains very strong, “We remain the largest G20 investor in India, British companies here invest almost double in India of what French and German companies do. One in 20 of the jobs in the formal sector are with British companies. By reverse, Indian companies invest more in the UK than the whole of EU combined. Last year, increase in service and goods trade both was 15 per cent.”

He also said that with “the shift of gravity to the east from the west”, the two countries are trying to adapt to an uncertain and changing world. He said India and Britain are still working out “how two countries who share fundamentally the same values, how they manage that adaptation”.

पूर्व आई ए एस अधिकारी प्रदीप कासनी ने थमा कांग्रेस का दामन

पूर्व आईएएस अधिकारी प्रदीप कासनी के कांग्रेस में शामिल होने की खबर से हरियाणा में राजनीतिक चर्चाओं का बाजार गर्म हो गया है। प्रदीप कासनी की कार्यशैली के कायल रहे हरियाणा के स्वास्थ्य मंत्री अनिल विज ने कासनी के इस फैसले को निजी बताकर चर्चाओं पर विराम लगाने का प्रयास करते हुए कहा कि यह उनका अपना फैसला है। वह किसी भी दल में जाएं वो उन पर निर्भर करता है।
बता दें, राहुल गांधी की अगुवाई में कांग्रेस का हाथ थामने वाले हरियाणा के पूर्व आईएएस अधिकारी प्रदीप कासनी अब पक्के कांग्रेसी हो गए हैं। दिल्ली में कांग्रेस के प्रदेश अध्यक्ष अशोक तंवर के नेतृत्व में राहुल गांधी से मुलाकात करके कासनी आधिकारिक रूप से कांग्रेस में शामिल हो गए।
खेल विभाग के प्रिंसिपल सेक्रेटरी अशोक खेमका द्वारा बड़ा खुलासा किया गया है। मीडिया में आई खबरों के अनुसार प्रदेश में नई खेल नीति आने के बाद खेल विभाग के अधिकारियों द्वारा अपने चहेतों पर इनामों की बरसात करके विभाग को लाखों का चूना लगाया है। इस खुलासे के सवाल पर बोलते हुए खेल मंत्री अनिल विज ने कहा कि इस मामले में उनकी अशोक खेमका से बात हुई है, उन्हें कहा गया है कि इस मामले में कहीं पर कोई गलती हुई होगी तो उसकी जांच करवाई जाएगी और दोषियों पर सख्त से सख्त कार्रवाई की जाएगी।

Shimla is witnessing a major water crisis during peak tourist season with taps running dry for the eighth day in most parts of the city, forcing people to buy water at exorbitant prices and smaller hotels to cancel bookings even as drinking water supply in the Queen of Hills fell to less than 50% of requirements, courtesy a dry winter.

On Sunday night, about 100 people staged a midnight sit-in protest outside the waterworks office on the main Mall Road and the police stopped them from heading towards the residence of chief minister Jai Ram Thakur, who on Monday constituted a committee headed by chief secretary Vineet Chowdhary to monitor daily water supply.
