“NSUI organized a national protest in Delhi today against the anti-student and anti-youth policies of the BJP Government. The “Chhatra Aakrosh Rally” from Mandi House to Parliament Street under the leadership of National President Fairoz Khan saw thousands of NSUI workers express the disappointment of crores of young people across the country” said National Media Co-ordinator Deepanshu Bansal. The national protest was followed by Vidhan Sabha/CM House Gherao in states across the country and had representation from all the states, including distant states from the NE and South. NSUI proceeded with the protest in a peaceful manner but the police force brutally attacked the students who were present there to raise their voices. Many NSUI activists including the National President Fairoz Khan and other National Office Bearers including Delhi In-charge Mr. Anushesh Sharma got injured in the protest said National Secretary Saimoon faruqi.
NSUI workers were protesting the defrauding of students and youth by the Modi Government. Young people are being systematically denied quality and affordable education with repeated fee hikes and appointment of mediocre RSS VCs and faculty. At the same time, young graduates are finding themselves excluded from productive participation in the economy due to lack of jobs. There is hatred and violence and mob justice across the country instigated by RSS and its affiliates.
NSUI representing the voice of the idealistic and free youth is committed to raising its voice against injustice everywhere. We are educated youth, we are the Future of India and will also play a constructive role in national politics. NSUI National President Fairoz Khan said, “The NSUI having raised its voice against this failed government will now launch a national campaign to draft the youth agenda for the Future of India.”

Zee Media sends legal notice to Majihtia for defaming its editor, seeks Rs 100 crore as damages


Zee Media Corporation Limited (ZMCL) has sent a legal notice to Shiromani Akali Dal (SAD) leader Bikram Singh Majithia for his alleged defamatory allegation against TV channel’s Punjab, Haryana and Himachal editor Dinesh Sharma.

In the legal notice sent on behalf of the ZMCL, Supreme Court lawyer Petal Chandhok asked Majithia to tender an unconditional written apology and publicly withdraw the false allegation against his client.

While talking to mediapersons at Hoshiarpur on August 2, Majithia had reportedly alleged that Sharma had demanded Rs 20 crore from him before 2017 Punjab assembly elections for favourable reportage. However, Sharma had denied having made such an offer.

The ZMCL counsel has also sought an assurance from Majithia that he will not repeat such defamatory act in future, failing which they will seek Rs 100 crore on account of damages suffered by his client.

Punjab government to seek review of SC order on DGPs’ appointment


The government feels the implementation of the said directions of the apex court would lead to political interference in state matters. 

Punjab Police Act 2007 to be amended to set up State Police Commission for appointment of DGP


Chandigarh, August 9, 2018:

The Punjab Government has decided to seek a review of the Supreme Court order of July 3, 2018, directing states to choose and appoint their Director General of Police (DGP) from a panel to be constituted by the UPSC based on the concerned state government’s proposals.

The government feels the implementation of the said directions of the apex court would lead to political interference in state matters.

Chief Minister Captain Amarinder Singh has accepted the opinion of State Advocate General Atul Nanda that the directions amounted to infringement, by the Centre, of the state’s powers, since Law & Order was a state subject as per the provisions of the Indian Constitution.

According to an official spokesperson, a decision has been taken under the aegis of the Chief Minister to file an application in the apex court for modifications of its directions in its order dated July 3, after amending the Punjab Police Act 2007 to enable the constitution of a state police commission for appointment of DGP. The suggested procedure would be in line with the recommendations of the SC in Prakash Singh & Ors. v. Union of India & Ors., (2006) 8 SCC 1 (Prakash Singh’s case), according to the government.

In Prakash Singh’s case, the court had issued directions concerning police reforms in the various States. This included a direction to select the DGP of the state “from amongst the three senior-most officers of the Department who have been empaneled for promotion to that rank by the Union Public Service Commission (UPSC) on the basis of their length of service, very good record and range of experience for heading the police force.”

In its July 3, 2018 orders, the SC has directed states that “when they anticipate vacancy in the post of DG, they shall send their proposals to the Union Public Service Commission well in time i.e. atleast 3 months prior to the date of retirement of the incumbent on the post. The UPSC shall then prepare the panel as per the directions of in the judgment reported in (2006) 8 SCC 1, out which the State shall pick its DG.”

The apex court has further directed “that any legislation/rule framed by any of the States or the Central Government running counter to the direction shall remain in abeyance to the aforesaid extent.” It has, however, granted liberty to the states to approach the court for modification of the above direction in the event they are aggrieved by it.

The Chief Minister had sought the AG’s opinion in the matter and asked him to suggest the way forward for the state government. The matter assumes significance in view of the fact that the incumbent DGP, Suresh Arora, is due to retire on September 30, 2018.

In his opinion, Nanda has pointed out that the directions in Prakash Singh’s case were passed by the Supreme Court “in light of the absence of any legislation then occupying the field at that time”. He further notes that the State of Punjab had enacted the Punjab Police Act, 2007 on 5.02.2008, and Section 6 of the Act dealt with the selection and term of office of the DGP “but does not provide for selection of DGPs from the panel as prepared by the UPSC.”

In the grounds made out by him for seeking review of the SC decision, Nanda says a reading of Prakash Singh’s case judgement makes it evident that the directions therein were to stay in force only till the respective State legislations were enacted.

Further, he points out that Police is a subject-matter covered under Entry 2, List II of the Seventh Schedule of the Constitution and thus is under the exclusive legislative domain of the State Government. After the enactment of the Punjab Police Act, 2007, the selection and appointment of the DGP would take place as per the provisions therein, and this would continue until the Act or any provision is specifically struck down by the Court in exercise of its powers of judicial review, having found the provision/Act to be unconstitutional, he says.

The AG goes on to cite various judgements to argue that the directions issued in Prakash Singh’s case were meant to operate only till such time as they were replaced by a suitable legislation (in this case the 2007 Act).

He further points out that the state legislations had been kept in abeyance in the order of July 3, which was passed without hearing any of the States on the provisions of the various State enactments. In fact, the Supreme Court overlooked the fact that the prayer of the Union of India in the application for directions did not concern the issue of empanelment by the UPSC at all and was only restricted to the term of the DGP, in the opinion of the AG.

In fact, he said one has to appreciate that a writ petition of 2013, dealing with the constitutional validity of the state enactments, was still pending before the court, which did not take it up for hearing or consider it before passing its order.

Finding the SC order to be an infringement of the legislative and executive powers of the state, as well as the Parliament, Nanda has said that the SC order “grossly restricts and interferes with the ability of the State to appoint a candidate as DGP who is responsible for administering, controlling and supervising the police service to ensure its efficiency, effectiveness, responsiveness and accountability in the State.”

According to him, the Constitution has limited the functions of the UPSC to the extent of “consultation” on matters of “suitability of candidates for such appointments, promotions or transfers” – it does not empower the UPSC to determine the suitable candidates as is contemplated SC decision. And powers exercised by the SC under Articles 32 and 142, as done in the instant case, are required to be consistent with the provisions of the Constitution, he adds.

Nanda has also suggested the various amendments to be made to the Punjab Police Act, 2007 to pave the way for setting up the state police commission.

Deshraj has been found guilty, quantum of the sentence on Friday

 

Six years after he was caught taking a bribe of Rs 1 lakh from an SHO, Deshraj Singh, an IPS officer, was held guilty by a special court here on Wednesday. Deshraj, who was then SP (City), has been found guilty under Section 7 and Section 13 (2) read with Section 13(1)(d) of the Prevention of Corruption Act. The court will pronounce the quantum of the sentence on Friday.

The 2008-batch IPS officer had allegedly demanded Rs 2 lakh from the then SHO of the Sector 26 police station, Anokh Singh, for “taking care” of an inquiry that Deshraj had initiated against him. Anokh Singh contacted the CBI, which laid a trap and nabbed Deshraj soon after he took the money.

The inquiry against Anokh Singh was opened for dereliction of duty and insubordination. According to the CBI chargesheet, Deshraj had then called Anokh Singh and demanded a bribe of Rs 2 lakh. Deshraj had said he would “twist his statement” and prevent action against the SHO.

In his final defence in the court, Deshraj took two pleas. One was that he never took the money and Anokh had kept it at his house while he had gone to the other room. CBI counsel KP Singh questioned as to why the CFSL report proved that his hands had touched the bribe money, which were smeared with phenolphtalein powder. (Deshraj’s fingers were dipped in a colourless solution, which turned pink; it is possible only after coming in contact with phenolphthalein powder).

The second defence taken by Deshraj was that Anokh Singh had come to meet him regarding another inquiry which was on against a constable. However, the CBI had questioned as to why an SHO would come to discuss or pay bribe for someone else.

Had demanded Rs 2 lakh 

A 2008-batch IPS officer, Deshraj had allegedly demanded  Rs 2 lakh from the then SHO of the Sector 26 police station, Anokh Singh, for “taking care” of an inquiry that Deshraj had initiated against him. However, Anokh contacted the CBI, which laid a trap and nabbed Deshraj soon after he took Rs 1 lakh.

राज्यसभा के उपसभापति के लिए हुए चुनाव में एक बार फिर विपक्ष को हार का मुंह देखना पड़ा है. इस हार के बाद सोनिया गांधी ने कहा कि कभी हम जीतते हैं और कभी हार होती है. कांग्रेस अध्यक्ष का पद छोड़ चुकी सोनिया फिलहाल यूपीए चेयरपर्सन हैं.

एनडीए की तरफ से जेडीयू के राज्यसभा सदस्य हरिवंश उपसभापति पद के लिए उम्मीदवार थे. गुरुवार को उन्हें इस पद के लिए चुना गया. उन्हें विपक्ष की ओर से कांग्रेस के उम्मीदवार बी के हरिप्रसाद को मिले 105 मतों के मुकाबले 125 मत मिले.

हरिवंश के पक्ष में जेडीयू के आरसीपी सिंह, बीजेपी के अमित शाह, शिव सेना के संजय राउत और अकाली दल के सुखदेव सिंह ढींढसा ने प्रस्ताव किया. वहीं हरिप्रसाद के लिए बीएसपी के सतीश चंद्र मिश्रा, आरजेडी की मीसा भारती, कांग्रेस के भुवनेश्वर कालिता, एसपी के रामगोपाल यादव और एनसीपी की वंदना चव्हाण ने प्रस्ताव पेश किया.

नेता सदन अरुण जेटली, नेता प्रतिपक्ष गुलाम नबी आजाद, संसदीय कार्यमंत्री अनंत कुमार और संसदीय कार्य राज्यमंत्री विजय गोयल ने हरिवंश को बधाई देते हुए उन्हें उपसभापति के निर्धारित स्थान पर बिठाया. इसके बाद प्रधानमंत्री नरेंद्र मोदी ने हरिवंश को शुभकामनाएं देते हुए उनके अनुभव के हवाले से उनके निर्वाचन को सदन के लिए गौरव का विषय बताया.

सूत्रों के हवाले से बताया जा रहा है कि हरिवंश को बीजेपी गठबंधन पार्टियों के 91 सदस्यों के अलावा तीन नामित सदस्यों और निर्दलीय अमर सिंह का वोट मिला. इसके अलावा उन्हें गैर एनडीए दलों-एआईएडीएमके के 13, टीआरएस के छह, इनेलो के एक सदस्य का समर्थन मिला. बीजेडी के 9 सांसदों ने भी हरिवंश को वोट किया. कुल मत 123 हुए लेकिन कहा जा रहा है कि दो निर्दलीय सांसदों ने भी एनडीए के पक्ष में वोट किया जिससे कुल आंकड़ा 125 बैठता है. वाईएसआर कांग्रेस के दो सदस्य वोटिंग से गैर-हाजिर रहे.

Haryana Police gets FICCI award

Haryana Police has bagged maiden Federation of Indian Chambers of Commerce and Industry (FICCI) award in the category of ‘Standards and Guidelines for Training’ in recognition of best practices for Private Security Agencies Regulation Act (PSARA) enforcement in the country.

While stating this on Wednesday, Director General of Police (ADGP), BS Sandhu said that it is proud moment for the entire police force as it has got recognition at national level.

Haryana Police has bestowed with the honor under the classification of licenses issuance process, PSARA verification process and timelines for granting the licenses.

He said that the award was presented by Union minister for skill development and entrepreneurship, Dharmendra Pradhan in the Private Security Industry Conclave- 2018 recently held in Delhi.

On behalf of Haryana Police, additional DGP (law and order) Mohd Akil, who is also controlling authority for enforcement of PSARA, received the award from Union minister.

While appreciating ADGP Mohd Akil and his entire team for this remarkable achievement, the DGP said that FICCI has for first time instituted the PSARA Enforcement Awards for the State Controlling Authorities, with the objective to showcase the practises adopted by them for the proper enforcement and implementation of PSARA in the state.

Akil said that Haryana Police has framed guidelines for effective training of private security guards or security supervisors as per norms under the PSARA.

Only Indian residents(citzens) not NRIs can enjoy RTI : GOI

 

 

Non-Resident Indians cannot file Right to Information(RTI) applications to seek governance-related information from the Central government departments, the Lok Sabha was informed on Wednesday.

“Only citizens of India have the right to seek information under the provisions of Right to Information Act, 2005. Non-Resident Indians are not eligible to file RTI applications,” Minister of State for Personnel Jitendra Singh said in a written reply.

He said subject to the provisions of the Act, the citizens of India could file online application under the Right to Information Act, 2005.

“Currently, systems of 2,200 public authorities have been aligned to receive, process and reply to online RTIs from the applicants,” the Minister said.

Any applicant could visit the portal — www.rtionline.gov.in — and select the desired Ministry or department under the Central government and file an online RTI application. A detailed user manual and Frequently Asked Questions were available on the website to help in filing the application.

“Applicant can pay the requisite fee through online payment in this portal and submit the RTI application,” the Minister said.
