Gujarat ATS chief D G Vanzarais discharged by Bombay High Court in Soharbuddin encounter case

Applications challenging discharge granted to them by trial court were devoid of merit, says HC; the court had been hearing six revision petitions filed by accused policemen seeking discharge in the ‘fake’ encounter case

The Bombay High Court has discharged former Gujarat ATS chief D G Vanzarais and five others in the 2005-2006 encounter case of suspected gangster Sohrabuddin Shaikh, his wife Kausar Bi and their aide Tulsiram Prajapati.

Five revision applications challenging the discharge granted to five accused policemen by a trial court, and one by an officer challenging the rejection of his discharge orders by the same court had been filed in the HC, and a single bench led by Justice A M Badar had on July 16 reserved the verdict on them.

The five revision petitions had challenged the discharge of Vanzara, Gujarat IPS officer Rajkumar Pandian, Gujarat Police officer N K Amin, Rajasthan cadre IPS officer Dinesh M N and Rajasthan police constable Dalpat Singh Rathod in the case by a trial court. While three of them had been filed by Sohrabuddin Shaikh’s brother Rubabuddin Shaikh, who challenged the discharge to Pandian, Dinesh and Vanzara, the CBI had filed the remaining two pleas challenging the discharge of Amin and Rathod.

The court held that the applications challenging the discharge granted to them were devoid of merit.

Justice Badar had been conducting hearings on the revision pleas on a daily basis since July 4. He also conducting a separate hearing on a discharge plea filed by Gujarat IPS officer Vipul Aggarwal, and allowed his discharge too in the case on Monday.

The CBI had booked the five officials, along with 33 others, alleging their involvement in the “fake” encounters of Sohrabuddin Shaikh and Kausar Bi in November 2005 and Tulsiram Prajapati in December 2006.

The Gujarat Police had then claimed Sohrabuddin Shaikh had terror links.

The case had been shifted to a special court in Mumbai from Gujarat following a Supreme Court order. The encounter cases of Sohrabuddin Shaikh and Kausar Bi, and Prajapati were clubbed together in 2013 after the apex curt decision.

Between 2014 and 2017, the special court discharged 15 of these 38 accused, including 14 police officials and BJP president Amit Shah.

As per the CBI chargesheet, gangster Sohrabuddin Shaikh and Kausar Bi were abducted by officers of the Gujarat ATS and the Rajasthan Police from near Hyderabad, and killed in a fake encounter in November 2005.

Prajapati, an eye-witness to these killings, was shot dead in another staged encounter in December 2006 by some Rajasthan Police officials at the behest of the Gujarat and Rajasthan officers, who had been involved in the killing of Sohrabuddin and Kausar bi.

A co-accused in the encounter case, Vipul Aggarwal’s discharge plea had been rejected by the trial court last year. He had then approached the HC challenging the order, seeking parity with the others discharged.

NC, PDP and now Congress will bycott polls tomorrow

The Congress is reported to have received suggestions to not boycott the elections as such a step would provide a clear field to the BJP to sweep the polls in the absence of any strong candidates against them

With the National Conference (NC) and the PDP announcing to boycott the coming panchayats and urban local body polls in Jammu and Kashmir, the Congress has convened a meeting of party legislators and senior leaders in Srinagar on Tuesday to decide its stand on the issue. The Congress is reported to have received suggestions against poll boycott as such a step would provide a clear field to the BJP to sweep the polls in the absence of any strong candidates against them.

When contacted, Pradesh Congress Committee chief GA Mir said any decision on boycott would be taken on the basis of consensus in Tuesday’s meeting.

He, however, said the atmosphere was not conducive for holding these elections and the party had brought this to the notice of Governor Satya Pal Malik. The PCC wants that safety of the candidates and electorate should first be ensured before holding these elections.

Mir expressed surprise over the stand taken by the NC and the PDP to boycott the polls. If the NC was so serious about Article 35A then why did the party participate in the recent LAHDC elections in Kargil and Leh. “Mehbooba Mufti should have quit the coalition at the time allegations of the BJP backing an NGO that filed the petition against the Article 35A came to the fore,” Mir said.

After NC it is PDP to boycott Urban Local Bodies and panchayat polls

Mufti’s announcement comes days after the National Conference (NC) chief and MP Farooq Abdullah had announced that his party would contest all elections in the state until the centre cleared its stand on the Article 35-A.

Putting to uncertainty the upcoming rural polls in Jammu and Kashmir, the PDP chief and former Chief Minister Mehbooba Mufti on Monday announced that her party will boycott the panchayats and urban local body elections later this year and “will go to any extent to protect the Article 35-A against which petitions are being heard in the Supreme Court”.

Mufti’s announcement comes days after the National Conference (NC) chief and MP Farooq Abdullah had announced that his party would contest all elections in the state until the centre cleared its stand on the Article 35-A.

The boycott of the two main political parties of Kashmir is likely to throw the already delayed panchayat poll process in limbo. Their decision has comes after the Hurriyat leadership called for boycott of these elections.

On the other hand, it is learnt that the Governor Satya Pal Malik was firm on holding these elections and was consulting legal experts on also holding the local body and municipal corporation elections on non-party basis.

When asked whether the PDP would follow the NC that has decided to boycott also the assembly and Lok Sabha elections, Mehbooba told media persons that the boycott of PDP was only for the panchayats and urban local body polls.

She said the people of the state have “sacrificed a lot” and no one can fiddle with the validity of Article 35-A. “We don’t want any casualties or bloodshed” during elections under such tense atmosphere.

The PDP’s decision was announced by her after a meeting of the party legislators and senior leaders.

She said that during deliberations on the issue “it was noted with concern that the situation created by linking local bodies elections with the case pending in the Supreme Court about the Article 35-A has created serious apprehensions in the minds of people who genuinely see it as assault on the special constitutional position of the state”.

“The party feels that while the special position of the state is a matter of survival for its people and society, democratic system is its sustenance. It was felt that any attempt to impose any electoral exercise in the current atmosphere of fear and apprehension would seriously erode the credibility of the process and institutions,” she said.

“The party, therefore, urges the Government to review its decision to hold local bodies elections at this venture against the will of the people and instead focus on confidence building measures so that the state is assured of the inviolability of the constitutional guarantees that make it a special part of the Union of India”, she added.

Mehbooba said that as chief minister she had in a stern warning told the BJP and Prime Minister Narendra Modi that she would pull out of the alliance if any fiddling was done with Article 35-A by changing even any comma or fullstop, under any pretext, including property rights of widows or refugees will not be tolerated.

She said that she warned the Centre that no mainstream party would be there to carry the Indian flag in the Valley if fiddling with the constitutional provision goes on unabated. Mehbooba said that the constitutional position was the only bridge between rest of India and Kashmir and if it is eroded then the accession of the state would come into question.

Article 35-A, which gives special rights to people in the state and bars outsiders from owning immovable property, has been challenged in the Supreme Court. In August, the top court deferred the case till January 2019.

She confirmed that the Governor had visited her but only pleasantries were discussed over a cup of tea.

Shiv Sena’s situation is like the dog which doesn’t know which way to look at: Raj Thackeray

“Nation has been seeing this for the last four years. All they did was write editorial prices on diesel and petrol. They’ve no role left to play. They don’t know what they’re supposed to do. No need to give them importance,” Raj said.

Maharashtra Navnirman Sena (MNS) chief Raj Thackeray compared Shiv Sena to a dog after the latter’s claim that the Bharat Bandh failed in Maharashtra.

Thackeray, whose party participated in the nationwide shutdown call given by the Congress, said Shiv Sena’s situation is like the dog which doesn’t know which way to look at.

“There’s a breed of dog which doesn’t know which way to look at. Same is Shiv Sena’s situation. When their money gets stuck, they talk of stepping out of alliance, when their work is done, they go silent,” he was quoted as saying by ANI.

Mocking the party led by his cousin and founder Balasaheb Thackeray’s son Uddhav, Raj Thackeray said that there was no need to pay attention to Shiv Sena because they are clueless.

“Nation has been seeing this for the last four years. All they did was write editorial prices on diesel and petrol. They’ve no role left to play. They don’t know what they’re supposed to do. No need to give them importance,” he said.

MNS activists led protests in Mumbai, Thane, Palghar, Pune, Nashik and others areas of the state.

In Dadar, MNS activists broke police cordons and waved black flags as the motorcade of Chief Minister Devendra Fadnavis zoomed past. In Andheri, they attempted to stop the Mumbai Metro Rail but there were no major dislocations in the services.

Earlier today, the Shiv Sena, which is an ally of the Bharatiya Janata Party (BJP) in the state and the Centre, said that the Bharat Bandh failed to generate desired impact in Maharashtra because the Uddhav Thackeray-led party was not “consulted” over the protest.

The Congress had approached Sena, which has openly criticised the BJP and Prime Minister Narendra Modi over a host of issues, only on Sunday. Sena turned down the request.

Senior Sena leader and Rajya Sabha MP Sanjay Raut Monday said the bandh would have generated better impact had the Congress consulted his party in advance.

“Those who do not understand Maharashtra had called for the bandh just ahead of Ganesh festival (beginning September 13). It was a wrong timing. Even the Goa congress did not participate in the bandh because of the Ganesh festival,” Raut told a Marathi news channel.

Maharashtra Minister of State for Home Deepak Kesarkar, who is from the Shiv Sena, said the bandh was observed only in half of Maharashtra.

Kesarkar said the bandh evoked “some” response because it was organised for a good cause, but not to the expectations of the Congress leadership.

“Based on a preliminary report with me, the success rate of the bandh across the state was around 47% to 50%, but I don’t want to politicise the protest,” he told reporters.

The nationwide shutdown was called by the Congress and other opposition parties to protest against the rising fuel prices.

Chief Minister Devendra Fadnavis (BJP) has already stated that his administration was exploring ways to slash the fuel prices.

“Some states in the country are largely dependent on revenue that comes from levying taxes on fuel. If fuel is brought under the ambit of the GST, these states will not benefit on the fiscal front and their economy might be in trouble,” Kesarkar said.

He said the prices of fuel can be brought down if all states come together.

India becoming favourite to US worries Dragon

In an opinion piece on last week’s India-US 2+2 dialogue, the Global Times, said it appeared the US’ South Asia policy has witnessed significant developments in the past few weeks.

India, sharing common anxieties with the US against a rising China, has assumed new importance on Washington’s radar while Pakistan can no longer enjoy a special status like it did during the war on terror in Afghanistan, a leading Chinese daily has said.

In an opinion piece on last week’s India-US 2+2 dialogue, the Global Times, which reflects the view of the Communist Party of China (CPC), said it appeared the US’ South Asia policy has witnessed significant developments in the past few weeks.

On the one hand, Washington announced it would cancel $300 million in military assistance to Pakistan and named Zalmay Khalilzad, a long-time critic of Pakistan, as a special envoy to Afghanistan while on the other it signed with New Delhi a long-due major military communications agreement which allows the two countries to closely coordinate on a compatible network just like the US and its closest allies do, the newspaper added.

It pointed out that the Trump administration, in its National Security Strategy and the National Defence Strategy, recently indicated that Washington’s strategic focus has shifted from dealing with global terrorism to managing major power rivalries.

“So, when it comes to its South Asia policy, this sea change in concept has also been materialised into concrete policy options toward both Pakistan and India,” it added.

As a result of Washington’s strategic focus shift, the US-Pakistan relationship has been troubled for some time. In his first talk about South Asian policy in August 2017, Trump went so far as to openly denounce Pakistan as the “safe havens” for terrorist organisations. Again, Trump’s very first tweet in 2018 was a surprising and scathing attack on Pakistan, accusing the country of providing “nothing but lies and deceit” in return for multi-billion US aid over past 15 or so years. Since then, Washington suspended more than $1.1 billion in security assistance to Pakistan.

The final cancellation of $300 million assistance announced on 1 September was actually part of Coalition Support Funds which had been suspended initially at the beginning of the year, the daily said.

In the post-9/11 era, the US offered billions of dollars to Pakistan in order to support counter-terrorism mission against Al-Qaeda, to operationalise robust intelligence cooperation and to equip Pakistani army with the capacity to target militants from all around.

But, as Al-Qaeda has been decimated over time and threat from other radical groups have grown, Washington found its aid to Pakistan increasingly hard to justify.

Even if Washington needs Islamabad to carry on their cooperation when it comes to the Afghanistan issue, the former, under the Machiavellian Trump administration, seemingly minds little if it approaches India at Pakistan’s expense, be it security and diplomatic.

Court rejects the petition of Rahul Sonia in AJL case

“The Congress knew that the High Court is going to pronounce the judgment in the ongoing National Herald case today and therefore deliberately called Bharat Bandh on Monday,” Patra said.

The Bharatiya Janata Party (BJP) on Monday said that the Congress party deliberately called for Bharat Bandh today to divert attention from the ongoing National Herald case in the Delhi High Court.

Addressing the media in New Delhi, BJP spokesperson Sambit Patra said the order issued by the Delhi High Court today proves that the Gandhi family was hoodwinking the poor people of the country.

“The Congress knew that the High Court is going to pronounce the judgment in the ongoing National Herald case today and therefore deliberately called Bharat Bandh on Monday,” Patra said.

“The court ruling exposes how the Gandhi family has been fooling the poor people of the country and looting their hard-earned earnings,” the BJP leader added.

In a setback to Congress president Rahul Gandhi and his mother Sonia Gandhi, the Delhi High Court on Monday dismissed their plea challenging the Income Tax notice seeking tax reassessment for the financial year 2011-2012.

The order of a bench came while hearing the plea of Rahul, Sonia Gandhi and her party colleague Oscar Fernandes against the March I-T notice seeking tax reassessment.

The I-T department told the court that they have concealed facts for evading tax and have not disclosed their income earned through Young Indian Pvt Ltd (YI) for the year 2011-2012.

The court said that the I-T department has powers to reopen tax proceedings and that the petitioners can approach the department with their grievances.

Reacting to the ruling, Patra said, “Whole Gandhi family today is known as a family of cheats, tax evaders and corrupts.”

He said that the Sonia Gandhi and Rahul embezzled Rs 5,000 crore of people’s money in the National Herald case.

National Herald newspaper was published by Associated Journals Limited (AJL), which was acquired by Young Indian in which Rahul Gandhi and Sonia Gandhi are major stakeholders.

Earlier in March, Young Indian requested the court to stay the recovery of tax and interest of Rs 249.15 crore raised in pursuance to a December 27, 2017 notice issued under section 156 of the IT Act for the assessment year 2011-12.

The company has submitted that it is a charitable firm and does not have any income and that Income Tax authorities have wrongly raised a demand of Rs 249 crore for the assessment year 2011-12.

On 19 March, the Delhi High Court directed Young Indian to deposit Rs 10 crore in the Rs 249.15 crore income tax proceedings against the firm.

BJP leader Subramanian Swamy had filed a complaint of “cheating” in the acquisition of AJL.

Swamy had accused them of allegedly conspiring to cheat and misappropriate funds by paying only Rs 50 lakh, by which Young Indian Pvt Ltd obtained the right to recover Rs 90.25 crore which AJL owed to the Congress.

The other accused in the case are Motilal Vora, Suman Dubey, Sam Pitroda and Young Indian.

Bharat Bandh Protest March

Receiving no good response to Bandh, Congress workers attack school bus, private vehicles, throw stone at trains attacking passengers!

The Congress and few of its allies had called for Bharat Bandh today to protest against the fuel price and the central government. However, the bandh call has not been successful as people felt it was a gimmick of the Congress party to utilize the situation for their benefits. It is well known that in 2013, the petrol prices under Congress had reached Rs 84 and then PM Manmohan Singh had vaguely said that they were unable to control the price because of global crisis.

But what congress has forgotten is, it was Modi government who has repaid the credit value of over 2 Lakh crore to the oil companies which were due since 5 years. This information was clarified 2 months back by the Petroleum minister himself.

And the real reason for fuel hike is the unimaginable debts which were created by Congress during their tenure.

The Congress which is responsible for this huge mess is today pretending to be saints and are creating disruption in the name of Bharat Bandh and Protest. Rahul Gandhi should be reminded that in 10 years of Congress rule, there was a whopping RS 47 hike in petrol prices. But in Modi government’s rule, there has been Rs 4-5 hike in 4.5 years.

But this was not the end, the Congress workers have targeted private vehicles of common citizens with stones and sticks just to create panic and project the Bandh was successful

There were also reports on attack on trains by Congress workers who were seen throwing stones targeting innocent passengers.

The worst part was, the so called protestors have attacked a school bus in Mumbai. It is unfortunate that in our country these goons destroy public property in the name of protests and bandhs. Only criminals can go to an extent of attacking school buses of innocent children and claim it to be freedom of speech and expression.

This is the real scenario of how these Bandh and protests are misused by political parties. The ultimate sufferers are only innocent people and common man who have to bear these criminals and goons.

The court will have to take suo moto action against the unruly behavior of Congress party workers or anyone who destroys public property and troubles commoners for their political gimmicks.
