Five points to note, even before the last vote is counted for analysis

Madhya Pradesh, Chattisgarh and Rajasthan are three States where the Congress and the BJP are face to face.

Trends continue to fluctuate in Rajasthan and Madhya Pradesh, into the afternoon on the counting day, but one thing is clear — Amarinder Singh, the leader of the lean club of Congress chief ministers will have some new members joining. It is not yet clear, how many.

Madhya Pradesh, Chhattisgarh and Rajasthan are three States where the Congress and the BJP are face to face, like Gujarat. In Telangana and Mizoram, the Congress is up against regional parties.

There are five points to be noted even before the results are complete

First, the BJP’s strongholds are under challenge. Madhya Pradesh, Rajasthan and Chhattisgarh, surrounding the Gujarat laboratory, are critical to Hindutva politics. The BJP has been in power since 2013 in MP and Chhattisgarh. The party sought to overcome anti-incumbency and corruption charges in these States by a high dose of Hindutva, generously deploying Uttar Pradesh Chief Minister Yogi Adityanath for campaigning. Perhaps that strategy worked to some extent and prevented a complete collapse of the party, though not enough to secure a comfortable win anywhere. What lesson will the BJP learn from this, for its 2019 campaign? A likely scenario will be that it will go for a mix of fresh populist government schemes and a sharp escalation of its Hindutva rhetoric. The mandir slogan is dusted and ready, for relaunch any time. We can’t be sure of its outcome.

Second point to be noted is the impact of the results on Mr. Modi’s individual standing. It can be argued that it was Mr. Modi’s personal appeal that prevented a complete rout of the BJP in Madhya Pradesh and Rajasthan. It is possible that when the 2019 election will be framed as a verdict on Mr. Modi and his politics, the scenario could be different from what we see today. But the news scenario of a weakened BJP at the state level in critical regions will force Modi to place himself at the centre of the campaign as he had done in 2014 too. The difference now is that he is no longer a challenger to the regime. He is the regime. He will double down on attempts to contrast himself with Rahul Gandhi. And that strategy as we know by now, can cut both ways. That strategy will require a progressive degeneration of his vocabulary and could turn off at least some sections of the electorate. Moreover, Mr. Modi has to now outsmart Mr. Yogi in the Hindutva game. A more detailed analysis of how the Modi factor worked in comparison with the Yogi factor in these core regions of Hindutva is likely to be done by the RSS. The internal dynamics of Hindutva politics will now play out less subtly in the coming months.

Thirdly, this election proves that there is limit to cleverness. In Chhattisgarh, the BJP talked up the Ajit Jogi-Mayawati alliance as a third force and its government tacitly supported it. At the end of the day, the new formation took down the BJP that finished third in Bilaspur and surrounding region. Far from harming the Congress, Mr. Jogi’s exit turned out to be boon for the Congress and his new party and the coalition contributed to the BJP’s downfall.

Fourth point is about Congress. This election puts the Congress party, and more specifically its president Rahul Gandhi, as the central character of opposition politics nationally. How the Congress will process its new status, how it will try to project that into other states where it is not the principal opponent of the BJP such as U.P and negotiate with regional partners are critical factors to track as India shifts gear to the campaign for the 17th general election next year.

Fifth point is how will the regional parties process the new status of the Congress as they are themselves wary of any improvement in the fortunes of India’s Grand Old Party. For their continuing prominence in their respective regions, they need the BJP as an enemy more than they need Congress as a friend. In 2004, this apparent contradiction was overcome by the genius and authority of Harkishan Singh Surjeet, then general secretary of the CPI (M). The CPI(M)’s own standing as a national party, without any claim for itself helped. In the absence of such a figure amongst them, can non-Congress parties forge an understanding that will bring them together around a Congress nucleus to form a national anti-BJP coalition? That question remains open today.

In UK court, former liquor baron’s legal team called Indian judiciary ‘corrupt’, questioned CBI’s competency

New Delhi:

A UK Court today refused to buy the argument that the Indian judiciary is corrupt while clearing extradition of former liquor baron Vijay Mallya to India, who is wanted in India on charges of fraud and money laundering amounting to around Rs 9,000 crore.

Brushing aside the witness statement given by Martin Lau, professor of law at the School of Oriental and African Studies, who was deposed on behalf of Mallya as an expert on South Asian law, Chief Magistrate Judge Emma Arbuthnot observed: “I do not accept that the courts in India are there to do what the politicians tell them to do. As I have already said, the court will be under great scrutiny. I do not find any international consensus which would enable me to find that the judges in India are corrupt. The most the Professor could do was give me a handful of individual examples where the process appeared to be defective in one way or another. Such defective processes came to light and were corrected by the senior courts.”

Mallya’s defence team tried to raise questions over not only the Indian judiciary but also the premier investigating agency probing his case. The defence team raised the issue of political interference and questioned the competency of the agency by raising the Arushi Talwar murder case.

Judge Emma, in the judgment, said that defence witness professor Lau questioned the independence of the judiciary.“(Clare) Montgomery and (Ben) Watson (Mallya’s defence team) submitted (that) it is particularly vulnerable to abuse given the CBI’s lack of independence. They rely on the evidence of Professor Lau that in the CBI court, the CBI framed parents for a murder they did not commit…. The CBI was said to have failed to disclose exculpatory material, deliberately mislead experts and tutored a witness. The CBI court was not able to protect the defendants in that case.”

“The defence relies too on the evidence of professor Lau that the Supreme Court had given preferential treatment to the creditor banks in this case which made it appear less neutral and impartial. The Professor explained that the Supreme Court was heavily burdened but that the case against the RP and others proceeded at pace. The professor (Lau) said he had the highest respect for the court but had some doubts about the patterns of its decisions in (the) favour of the government. The professor made it clear that he was not saying it was a corrupt institution. It was just that judge nearing retirement lean in (the) favour of the government in the hope of later jobs.”

Professor Lau also criticised the Supreme Court of India for dealing with the civil case against Mallya too quickly. “I found this is not a relevant criticism as it was clear that the proceedings were an ex parte application for an interim injunction. The professor made it clear that he had the highest respect for the Indian Supreme Court…. There was no evidence which allowed me to find that if extradited, Mallya was at real risk of suffering a flagrant denial of justice,” the UK Court said in the judgment.

Besides, Lau, Professor Lawrence Saez, a political-economic scientist was also presented as a witness by Mallya’s legal team. Professor Saez was called to express his views about whether Mallya’s prosecution was politically motivated as well as analyse the credentials of the CBI.

The UK court refused to buy the arguments made by professor Saez as well, in which he said that the politicians in India were using the controversy around Mallya to score political points against each other. The professor’s next suggestion was that the CBI who had investigated the case was susceptible to political interference. He argued there was concern about the lack of independence of the CBI and described the CBI as a “caged parrot” speaking with its master’s voice.

In cross-examination professor Saez agreed that Mallya’s political beliefs were not the most significant element with relation to the prosecution that was being brought against him. The professor also accepted that Mallya did not have any relationship with any of the main political parties.

“When asked whether he had said that the underlying allegations of fraud were untrue and that the prosecution was being brought about to punish the RP (Mallya) for his political opinions, he said no, but that the RP (Mallya) was a prominent businessman who became a politician. Both parties have used the case for their own political reasons. He said he was not an expert on fraud but on the political system. He was not qualified to say whether the allegations were true or untrue,” the Mallya extradition order said.

The order further said: “By a finding of a prima facie case, I acknowledge that this case is being brought on evidence which may or may not lead to the conviction of the RP (Mallya). There is no sign that this is a false case being mounted against him to assuage CBI’s political masters as professor Saez would have it…. I find no evidence to support the contention that the request for VJM’s extradition is, in fact, being made for the purpose of prosecuting or punishing him on account of his political opinions. The argument in relation to extraneous considerations fails.”

Fulfil promise to build Ram temple, RSS tells Centre

A sea of saffron was witnessed at Ramlila Maidan and roads leading to it in New Delhi as lakhs answered a Vishwa Hindu Parishad (VHP) call for a ‘Dharm Sabha’ on Sunday.

Suresh ‘Bhaiyyaji’ Joshi made this appeal at a VHP rally at Ramlila Maidan in Delhi

A sea of saffron was witnessed at Ramlila Maidan and roads leading to it in New Delhi as lakhs answered a Vishwa Hindu Parishad (VHP) call for a ‘Dharm Sabha’ on Sunday.

Various estimates suggested that over a lakh were present at the mega gathering organised to press the Centre for the construction of a Ram temple in Ayodhya.

The massive rally comes just two days before the commencement of Parliament’s winter session.

Amid chants of Jai Shree Ram, the gathering send across a message that the calls for a legislation to pave the way for the construction of the temple are now stronger.

At the rally, the executive head of Rashtriya Swayamsevak Sangh (RSS), Suresh ‘Bhaiyyaji’ Joshi, gave a warning to the Union government for the temple construction.

“Those in power today had promised to construct the Ram temple. They should listen to people and fulfil the demand. They are aware of the sentiments (of people),” he said without naming the Bharatiya Janata Party (BJP)-led NDA government at the Centre.

“We are not begging for it. We are expressing our emotions. The country wants Ram rajya,” warned the powerful RSS leader.

VHP president Vishnu Sadashiv Kokje and its international working president Alok Kumar are also expected to address the rally.

VHP’s spokesperson Vinod Bansal had earlier told PTI that the gathering will change the hearts of all those who are not in favour of bringing the bill for construction of a grand Ram mandir in Ayodhya.

Reports say that most of the supporters came from Ghaziabad, Gautam Budh Nagar, Baghpat and Meerut – all of them neighbouring districts in western Uttar Pradesh. Visuals on TV showed thousands on the streets waving saffron flags and carrying posters showing a temple.

Anticipating the turnout, the Delhi traffic police had already placed diversions around Ramlila Maidan.

No traffic was allowed on Ranjeet Singh Flyover (from Guru Nanak Chowk to Barakhambha Road), JLN Marg (from Rajghat to Delhi Gate), Chaman Lal Marg near VIP gate.

Snipers were deployed on high-rises around the Maidan and other security arrangements were made.

The final Dharam Sansad’ will be held on 31 January and 1 February.

Vijay Mallya extradition case edges towards ruling

On bail since April 2017, the former Kingfisher Airlines boss has contested his extradition on the grounds that the case against him is “politically motivated” and the loans he has been accused of defrauding on were sought to keep his now-defunct airline afloat

Chief Magistrate set to rule on India’s extradition petition on Monday.

Chief Magistrate Emma Arbuthnot is set to deliver her judgment on India’s efforts to extradite businessman Vijay Mallya to India on Monday. It will follow a trial that took place over the course of nine months, ending in September, following Mr. Mallya’s arrest in April 2017, on an extradition warrant.

India has been seeking the businessman’s extradition on charges of fraud and money laundering amounting to ₹9,000 crore. He has been on bail since his arrest.

The case focuses on loans disbursed by the IDBI Bank, with the prosecution arguing that Mr. Mallya never had the intention of paying back the loans, used misrepresentations (including on brand valuation) to obtain them, used the funds in ways that were never intended by the terms on which they were disbursed, and attempted to squirrel away parts of it.

“His company was in intensive care, the market was in intensive care, it was only heading in one direction, as it went down it was going to sustain huge losses and the defendant had a choice: either take those losses yourself and impinge on your own lifestyle or you try and palm them off onto a bank,” Mark Summers, the Crown Prosecution Service barrister told the court in December 2017 when the case kicked off.

The defence has rejected these contentions, insisting that the loans had been taken out as Mr. Mallya and Kingfisher Airlines attempted to rescue the business, amid unprecedentedly difficult conditions for the aviation sector, particularly because of high oil prices and sluggish demand in the wake of the global economic crisis.

It was a case of “business failure” rather than fraud, Mr. Mallya’s lead barrister Clare Montgomery told the court at the start of the case. They have also challenged the contention that it was used in ways never agreed to and have maintained that the guarantees provided – including through the valuation of the company – were nothing other than genuine.

Alongside challenging the main government case they — through expert witnesses — have sought to portray the case as politically motivated, and have raised concerns about jail conditions in India and in Arthur Road Jail in Mumbai, where Mr. Mallya would be detained before and (if convicted) after any trial there.

The defence had also challenged the admissibility of certain prosecution evidence – an attempt that failed in all cases save for email conversations covered by legal professional privilege.

The hearings have continued well beyond the original period envisaged, as the judge sought clarifications on jail conditions and other issues, including detailed notes on the conspiracy charges facing Mr. Mallya in India, as well as notional charges.

“It’s like a jigsaw puzzle,” remarked Arbuthnot during one of the hearings earlier this year.

While India’s attempt to extradite alleged bookie Sanjeev Chawla was initially rejected (it has successfully appealed and the case is to be reheard) because of concerns around jail conditions, in the final hearing – when final oral submissions took place – Arbuthnot indicated that, having received assurances and further details from India relating to jail conditions, that it was the prima facie case that would matter most to her.

Even if the judgment goes against Mr. Mallya, he is unlikely to be extradited to India any time soon, given the appeal options that would be open to him (and to India if it lost).

Mr. Mallya has attended the hearings, often making public statements inside and outside the court house. Among the most controversial came on the day of the final hearing in September when he let drop that he had met Finance Minister Arun Jaitley in Parliament before he left the country in March 2016 and told him he would be leaving for London.

Mr. Mallya has occasionally taken to Twitter to make public his defence arguments and point to the settlement offer he had made before the Karnataka High Court, relating to the loans from a consortium of 13 public sector banks. “I have offered to repay 100% of the principal amount to them. Please take it,” he tweeted last week.

Beef lover Historian Ramachandra Guha receives threatening calls

After a magical morning in Old Goa we had lunch in Panaji, where—since this is a BJP ruled state—I decided to eat beef in celebration

He said he had not filed any formal complaint, he had in fact informed a senior police official about the calls.

Now the question arises why? He is scared that he may not meet Gauri Lankesh’s Fate, he certainly needs security he should file a formal complaint against the mobile number owner and he must bring this matter to an end.

Two days after posting a photo of himself eating beef in Goa, Bengaluru-based author and historian Ramachandra Guha tweeted saying he had received threatening calls.

He told media persons in Bengaluru that the threatening calls started coming on his landline on Sunday morning.

Earlier in the day, he put out two tweets. In one, he said: “I have received threatening calls from a man calling himself Sanjay from Delhi. His number is +91-9X3X1-3X6X8 (number hidden on purpose). He threatened my wife as well as me. This is for the record.”

Replying to

You are not enjoying a meal while eating beef and sharing the picture on social are purposely mocking at the faith of millions. Suit yourself. How your ‘secular ‘ mindset has turned you into a totally insensitive human being is not difficult to see.

Within minutes, he put out a second tweet stating: “This threatening tweet below is from a former official of the Research and Analysis Wing. I would like to place it on record, and will do with every subsequent threat received.”

He told news men that while he had not filed any formal complaint, he had in fact informed a senior police official about the calls. “In the light of Gauri Lankesh murder and long hitlist, I thought I should keep the police informed… The photo was unnecessary, but I stand by my views,” he said.

Meanwhile, In another tweet, Mr. Guha said: “I have deleted the photo of my lunch in Goa as it was in poor taste. I do wish however to again highlight the absolute hypocrisy of the BJP in the matter of beef, and to reiterate my own belief that humans must have the right to eat, dress, and fall in love as they choose.”
