Chief Magistrate Emma Arbuthnot is set to deliver her judgment on India’s efforts to extradite businessman Vijay Mallya to India on Monday. It will follow a trial that took place over the course of nine months, ending in September, following Mr. Mallya’s arrest in April 2017, on an extradition warrant.

India has been seeking the businessman’s extradition on charges of fraud and money laundering amounting to ₹9,000 crore. He has been on bail since his arrest.

The case focuses on loans disbursed by the IDBI Bank, with the prosecution arguing that Mr. Mallya never had the intention of paying back the loans, used misrepresentations (including on brand valuation) to obtain them, used the funds in ways that were never intended by the terms on which they were disbursed, and attempted to squirrel away parts of it.

“His company was in intensive care, the market was in intensive care, it was only heading in one direction, as it went down it was going to sustain huge losses and the defendant had a choice: either take those losses yourself and impinge on your own lifestyle or you try and palm them off onto a bank,” Mark Summers, the Crown Prosecution Service barrister told the court in December 2017 when the case kicked off.

The defence has rejected these contentions, insisting that the loans had been taken out as Mr. Mallya and Kingfisher Airlines attempted to rescue the business, amid unprecedentedly difficult conditions for the aviation sector, particularly because of high oil prices and sluggish demand in the wake of the global economic crisis.

It was a case of “business failure” rather than fraud, Mr. Mallya’s lead barrister Clare Montgomery told the court at the start of the case. They have also challenged the contention that it was used in ways never agreed to and have maintained that the guarantees provided – including through the valuation of the company – were nothing other than genuine.

Alongside challenging the main government case they — through expert witnesses — have sought to portray the case as politically motivated, and have raised concerns about jail conditions in India and in Arthur Road Jail in Mumbai, where Mr. Mallya would be detained before and (if convicted) after any trial there.

The defence had also challenged the admissibility of certain prosecution evidence – an attempt that failed in all cases save for email conversations covered by legal professional privilege.

The hearings have continued well beyond the original period envisaged, as the judge sought clarifications on jail conditions and other issues, including detailed notes on the conspiracy charges facing Mr. Mallya in India, as well as notional charges.

“It’s like a jigsaw puzzle,” remarked Arbuthnot during one of the hearings earlier this year.

While India’s attempt to extradite alleged bookie Sanjeev Chawla was initially rejected (it has successfully appealed and the case is to be reheard) because of concerns around jail conditions, in the final hearing – when final oral submissions took place – Arbuthnot indicated that, having received assurances and further details from India relating to jail conditions, that it was the prima facie case that would matter most to her.

Even if the judgment goes against Mr. Mallya, he is unlikely to be extradited to India any time soon, given the appeal options that would be open to him (and to India if it lost).

Mr. Mallya has attended the hearings, often making public statements inside and outside the court house. Among the most controversial came on the day of the final hearing in September when he let drop that he had met Finance Minister Arun Jaitley in Parliament before he left the country in March 2016 and told him he would be leaving for London.

Mr. Mallya has occasionally taken to Twitter to make public his defence arguments and point to the settlement offer he had made before the Karnataka High Court, relating to the loans from a consortium of 13 public sector banks. “I have offered to repay 100% of the principal amount to them. Please take it,” he tweeted last week.

India to import Iranian crude oil using rupee payment mechanism


Oil refiners such as state-owned Indian Oil Corp (IOC) and Mangalore Refinery and Petrochemicals Ltd (MRPL) could use UCO Bank Bank to route oil payments to Iran.

India will import crude oil from Iran using a rupee-based payment mechanism, an industry source told media persons  on Thursday, adding that 50 percent of those payments will be used for exporting items to Tehran.

The United States last month re-imposed sanctions on Iran’s oil exports to punish Tehran for its involvement in several Middle Eastern conflicts.

Accordingly, India has signed an agreement with Iran to pay for crude oil it imports from the Persian Gulf nation in rupees, sources in know of the development said.

The memorandum of understanding (MoU) was signed following the US letting India and seven other nations to keep buying Iranian oil despite sanctions were reimposed on the Islamic state on 5 November.

Sources said Indian refiners will make rupee payments in a UCO Bank account of the National Iranian Oil Co (NIOC).

Half of these funds would be earmarked for settling payments for exports of Indian goods to Iran, they said.

Under the 180-day exemption, India is allowed to import a maximum of 300,000 barrels a day of crude oil. This compares to an average daily import of about 560,000 barrels this year.

India, which is the second biggest purchaser of Iranian oil after China, has since then restricted its monthly purchase to 1.25 million tonne or 15 million tonne in a year (300,000 barrels per day), down from 22.6 million tonne (452,000 barrels per day) bought in 2017-18 financial year, sources said.

Two of its refiners — Indian Oil Corp (IOC) and Mangalore Refinery and Petrochemicals Ltd (MRPL) — bought 1.25 million tonne of oil from Iran in November and December.

India, the world’s third biggest oil consumer, meets more than 80 percent of its oil needs through imports. Iran is its third largest supplier after Iraq and Saudi Arabia and meets about 10 percent of total needs.

US President Donald Trump in May withdrew from the 2015 nuclear accord with Iran, re-imposing economic sanctions on the Persian Gulf nation. Some sanctions took effect from 6 August, while those affecting the oil and banking sectors will start from 5 November.

Prior to this, India paid its third largest oil supplier in euros using European banking channels. These channels got blocked from November.

During the first round of sanctions when EU joined the US in imposing financial restrictions, India initially used a Turkish bank to pay Iran for the oil it bought. Beginning February 2013, India paid 45 percent of the oil import bill in rupees while keeping the remainder pending till the opening of payment routes. It began clearing the dues in 2015 when the restrictions were eased.

Sources said New Delhi may export goods, including wheat, soybean meal and consumer products, to Iran during the exemption period.

Iran was the India’s second biggest supplier of crude oil after Saudi Arabia till 2010-11 but Western sanctions over the Persian Gulf nation’s suspected nuclear programme relegated it to the seventh spot in the subsequent years. In 2013-14 and 2014-15, India bought 11 million tonne and 10.95 million tonne crude, respectively from Iran.

Sourcing from Iran increased to 12.7 million tonne in 2015-16, giving it the sixth spot. In the following year, the Iranian supplies jumped to 27.2 million tonne to catapult it to the third spot.

Iranian oil is a lucrative buy for refiners as the Persian Gulf nation provides 60 days of credit for purchases, terms not available from suppliers of substitute crude — Saudi Arabia, Kuwait, Iraq, Nigeria and the US.

Besides blocking of banking channels from November, shipping firms are unwilling to transport Iranian oil. To get around this, Iran is using its own ships to transport crude to India. Its insurance companies are also providing insurance cover for such shipments, sources added.

Government is finalising a proposal to amend the Act, following Supreme Court order upholding it but with conditions.


The government is in the last stages of finalising a proposal to amend the Aadhaar Act to give all citizens an option to withdraw their Aadhaar number, including biometrics and the data.

This follows the Supreme Court Judgement in September that upheld the validity of Aadhaar, however, with certain riders.

A Constitution Bench had struck down Section 57 of the Act that allows private entities to use the unique number for verification. The Bench also declared that seeking to link it with bank accounts and SIM cards was unconstitutional.

UIDAI proposal

“The initial proposal was prepared by the Unique Identification Authority of India (UIDAI). It submitted that once a child turns 18, he/she will be given six months to decide if he/she wants to withdraw,” a senior official said.

This proposal was sent to the Law Ministry to be vetted. “The Ministry further recommended that the option to withdraw be made available to all citizens, and not be limited to a particular group,” the official added.

However, the proposal, which will now be sent to the Cabinet, is likely to benefit only those who do not have a PAN card or do not require one, as the court had upheld the linkage of PAN with Aadhaar.

Over 37.50 crore PANs have been issued till March 12, 2018. Of these, the number of PANs issued to individuals stood at more than 36.54 crore, of which about 16.84 crore PANs have been linked with Aadhaar.

In line with the court order, the proposal seeks to appoint an adjudicating officer to decide whether a person’s Aadhaar-related data need to be disclosed in the interest of national security.

The court had also struck down Section 33(2), which allowed disclosure of Aadhaar information for national security reasons on the orders of an officer not below Joint Secretary. It had said an officer above Joint Secretary should consult a judicial officer and together take a call.

Animal Husbandry & Fisheries participated for the first time in the 13th Agro Tech-2018

Chandigarh, 3rd December 2018:

Responding to the Government of India initiative for doubling the farmer income, the Department of Animal Husbandry & Fisheries participated for the first time in the 13th Agro Tech-2018, India organised by CII Chandigarh.

The Department of Animal Husbandry in exhibition focused on the activities undertaken by it regarding efficient animal healthcare system and disease control. The extension activities depicting better scientific Animal Husbandry practices were displayed.

On the inaugural day, Sh. Tejdeep Singh Saini, Director Animal Husbandry revealed that the departments’ effort to produce quality fish seed was highlighted for conservation of ecological balance of Sukhna Lake. Large number of farmers from different states of Punjab, Haryana and Himachal visited the stall on the first day. Foreign dignitaries from Canadian High Commission, Chandigarh also visited the stall and appreciated the work done by the Department.

Farmers were educated about various animal husbandry activities for economical production of milk, various bio-security measures to prevent diseases.

President of India Inaugurates 13th Edition of CII Agro Tech India – 2018


Chandigarh, December 1, 2018: 

Hon’ble President of India, Sh. Ram Nath Kovind inaugurated the 13th CII Agro Tech India 2018, a premier Agri and Food Technology Fair, at the Parade Ground in Chandigarh today.

Speaking on the occasion, the President said that Indian agriculture needs a renewal of its marriage with contemporary technology; protection against climate change, price fluctuations and demand shocks; and sustained investment by and partnership with business. Together these will enhance agricultural value and competitiveness – as well as lead to better incomes.

The President said that through human history, agriculture has moved ahead with cross-fertilization. It is the ideal stage for partnerships, for symbiosis and for mutual learning and sharing. Partnerships can be formed across sectors and across geographies. In previous decades, manufacturing and mechanisation have been of appreciable utility to agriculture. Today a strong relationship is emerging between agriculture and the services sector. Biotechnology, nanotechnology, data science, remote-sensing imaging, autonomous aerial and ground vehicles, and artificial intelligence hold the key to generating more value for agriculture. He expressed confidence that Agro Tech India-2018 will promote specific partnerships that will benefit India’s farmers.

Pointing to the issue of pollution due to stubble burning, the President said that the farmers of Punjab and Haryana are a matter of pride for our country. They have never shied away from a challenge and a responsibility to larger society. Today we are facing a problem related to disposal of crop residue and of safe and clean removal of husk or stubble. In an extreme form, the burning of such items is leading to pollution that affects even little children. It is for all of us, including the state governments, the skilled and large-hearted farmers, and other stakeholders, to come up with a solution. And no doubt technology will help us find a solution.

In his address, Mr Rakesh Bharti Mittal, President, CII said, “As our farmers have met the goal of food security, farming should now be seen as a wealth creation tool. Today’s new age farmer is an entrepreneur and CII is doing a lot to contribute to the cause of doubling the farmers’ income.  We have recommended to the government that states be ranked on an index called ‘Ease of Doing Agriculture’ on the lines of the Ease of Doing Business.”

Mr Mittal also called for reforms in long-term leasing of land, incentivizing farmers who adopt technology and how to synergise farmers and government’s efforts to ultimately benefiting the consumer at the other end.

Union Minister for Food Processing Industries, Smt Harsimrat Kaur Badal said, “The time is now ripe for food processing to ensure food for more people in the world and in our country. According to my own Ministry’s study, around Rs1 lakh crore worth of agri-produce is wasted for lack of processing. My Ministry had launched KISAN SAMPADA YOJANA as the prime seven umbrella scheme.”

She informed the gathering of a new scheme that the ministry is partnering with the World Bank to create a food processing revolution. “Rs 3,000 crore will be used to fund farmers for projects up to Rs 10 lakh each,” she added.

The ministry, she added, was also creating a new funding mechanism to finance food processing projects.

Recounting the achievements of the government, Union Minister for Agriculture and Farmers’ Welfare, Shri Radha Mohan Singh said, “We have doubled the investment in the sector to around Rs 450 crore per year from Rs 200 crore previously. We have also created corpus funds.”

Welcoming the dignitaries, Mr Ajay S Shriram, chairman and senior managing director, DCM Shriram Ltd, and chairman, CII Agro Tech India, 2018, said, “Since its inception in 1994, CII Agro Tech has brought together agribusiness communities from all around the world. The CII Agro Tech India 2018 focuses on leveraging innovation and technology for sustainable development of agriculture and doubling farmers’ income. Spread over 16,000 sq m of space, 14 states and eight countries are participating in the agri technology fair.”

 “The idea is to understand what is required from farmers to double their income in the medium term. Over 50,000 farmers are expected to visit us during the event,” he added.

Thanking all the dignitaries present, Mr SACHIT JAIN, Chairman, CII, Northern Region said, “Application of technology with linkages to market is the key to sustainable agriculture. CII is working on a pilot project to tackle stubble burning in Punjab. We will take it forward in the times to come and fulfill the dreams of Hon’ble President.”

The 13th CII Agro Tech India event witnessed 158 domestic exhibitors and 37 international exhibitors. The exhibition that has been set up in the 16,000 square m area and has the participation of 14 states and 8 countries.

भारत सरकार ने विजय माल्या और नीरव मोदी जैसे आर्थिक अपराधियों की धर-पकड़ के लिए जी-20 सदस्य देशों की बैठक में 9 सूत्री एजेंडा रखा है. इस एजेंडे में कहा गया है कि घोटाला किए गए धन को प्रभावी तरीके से फ्रीज करना, अपराधियों को उनके देश में जल्दी से जल्दी प्रत्यर्पित करने और घोटाले की राशि को रिकवर करने के लिए सहयोग बढ़ाने की जरूरी है.

पीएम मोदी ने अंतरराष्ट्रीय व्यापार और अंतरराष्ट्रीय वित्तीय व टैक्स सिस्टम के दूसरे सेशन के वक्त यह एजेंडा पेश किया. इसमें आगे कहा गया है कि यूनाइटेड नेशंस कनवेंशन अगेंस्ट करप्शन (यूएनसीएसी) और यूनाइटेड नेशंस कनवेंशन अगेंस्ट ट्रांजेक्शनल ऑर्गेनाइज्ड क्राइम (यूएनओटीसी) से संबंधित अंतरराष्ट्रीय सहयोग को फिर से प्रभावी तरीके से लागू किया जाए. भारत ने आर्थिक अपराधियों के जी-20 देशों में प्रवेश और सुरक्षा दिए जाने से मना करने पर भी मकैनिज्म बनाने पर जोर दिया.

भारत ने सुझाव दिया कि फाइनेंशियल एक्शन टास्क फोर्स (एफएटीएफ) को कहा जाना चाहिए कि अंतरराष्ट्रीय मामलों मे सहयोग बढ़ाने के लिए और सूचनाओं के आदान-प्रदान करने की दिशा में प्राथमिकता के तौर पर काम करे.

इसमें कहा गया कि एफएटीएफ द्वारा भगोड़े आर्थिक अपराधियों के लिए एक पुख्ता परिभाषा बनानी चाहिए. एफएटीएफ द्वारा इन अपराधियों ने निपटने के लिए ऐसे अपराधियों की पहचान, प्रत्यर्पण और न्यायिक प्रक्रिया से संबंधित एक मानक प्रक्रिया भी बनानी चाहिए.

भारत ने अपने अनुभवों को एक-दूसरे से साझा करने के लिए एक कॉमन प्लेटफॉर्म बनाने की भी हिमायत की और कहा कि जी-20 फोरम को कोशिश करनी चाहिए कि जितने भी आर्थिक अपराधी हैं उनकी जितनी भी परिसंपत्तियां हैं वो जब्त करनी चाहिए.

अखिल भारतीय उद्योग व्यापार सुरक्षा मंच के राष्ट्रीय संगठन मंत्री व हरियाणा प्रभारी विजय बंसल की स्वीकृति से तथा प्रदेशाध्यक्ष प्रदीप अग्रवाल की सहमति से जिला पंचकूला इकाई का गठन कर जिले के व्यापारी व उद्योगपतियों को एहम जिम्मेवारियां सौपी गई।इससे पूर्व संगठन की कार्यकारिणी की बैठक भी ली गई जिसमें व्यापारियों व उद्योगपतियों के उत्थान के लिए विभिन्न योजनाओं के बारे विचार विमर्श किया गया।जिले के उद्योगपति-व्यापारियों के हितों की सुरक्षा के लिए यह संगठन राष्ट्रीय स्तर पर प्रयासरत है।पंचकूला के भगवान दास मित्तल को जिला अध्यक्ष की जिम्मेवारी सौपी गई है।

विजय बन्सल ने प्रेस वार्ता के दौरान अपने सम्बोधन मे बताया कि इस क्षेत्र में व्यापार व उद्योग दोनों खत्म हो चुका है। यहां दो बड़े उद्योग थे एचएमटी व एसीसी। एसीसी को 1997 में व एचएमटी का ट्रेक्टर प्लांट बन्द करदिया तथा मशीन टूल्स बन्द होने के कगार पर है जिससे कालका-पिंजोर व आसपास का व्यापार खत्म हो गया है। भाजपा के शासन में व्यापारी व उद्योगपति त्राहि त्राहि कर रहा है जिसके लिए अखिल भारतीय उद्योग व्यापार सुरक्षा मंच आवाज उठाने के लिए एक बेहतर रास्ता है। इस मंच के माध्यम से, राज्य व केंद्र सरकार से मांग की है कि जिला पंचकूला में कोई बड़ा उद्योग लगाया जाए, एचएमटी की खाली भूमि पर कोई उद्योग लगाया जाए आदि। इसके साथ ही शिवालिक क्षेत्र को औद्योगिक पैकेज देने के भी मांग करी गई। बंसल ने भाजपा के चार वर्ष के कार्यकाल को व्यापारी विरोधी बताया क्योंकि नोटबन्दी, जीएसटी की मार से व्यापारी व उद्योगपति उभर नही पाया है।

बीमार उद्योगों पर बात करते हुए विजय बंसल ने कहा कि शिवालिक क्षेत्र पर लागू अधिनियम उद्योग विरोधी हैं। जबकि कुछ ही किलोमीटर की दूरी पर बद्दी में ये समस्या नहीं है इसलिए उद्योगपति हरियाणा में अपनी इकाई लगाने की बजाय हिमाचल में निवेश करते हैं जिससे कि प्रदेश को काफी नुक्सान होता है।

प्रदीप अग्रवाल, प्रदेशाध्यक्ष ने कहा कि उद्योग व्यापार मंच ने हमेशा व्यापारी व उद्योगपतियों की आवाज को उठाया है।प्रदेश में व्यापारी कल्याण बोर्ड का गठन, 2100 दुकानदारों को मुआवजा, दिवाली की समय दुकानदारों को मुआवजा दिलवाने जैसे व्यापारी व उद्योगपतियों के हित में काम करवाए है।

भगवान दास मित्तल ने पत्रकारों से रूबरू होते हुए बताया कि संगठन को जिले स्तर पर मजबूत किया जा रहा है।ब्लाक स्तर पर अध्यक्ष नियुक्त कर दिए गए है,जिले की कार्यकारिणी में हर कोने से व्यापारियों व उद्योगपतियो को जिम्मेवारियां सौप कर मजबूत किया गया है।इसके साथ साथ आने वाले समय मे अन्य व्यापारी व उद्योगपति साथियो को भी साथ मे जोड़ा जाएगा।

आजकल डिजिटल का जमाना है। शहरों से लेकर गांवों तक स्मार्टफोन की उपलब्धता आसान होने से इंटरनेट यूज करने वाले लोगों की संख्या में तेजी से इजाफा हो रहा है। सभी तरह का कंटेंट इंटरनेट पर आसानी से उपलब्ध है। ऐसे में इन दिनों फेसबुक, ट्विटर और यूट्यूब का इस्तेमाल करने वालों की संख्या में भी लगातार बढ़ोतरी होती जा रही है। अपने प्लेटफॉर्म पर यूजर्स की बढ़ती संख्या को देखते हुए ये कंपनियां भी अब इस मौके को भुनाने में जुट गई हैँ।

अंग्रेजी अखबार ‘द इकनॉमिक टाइम्स’ में छपी एक खबर के मुताबिक, विडियो शेयरिंग प्लेटफॉर्म यूट्यूब ने अपने होमपेज पर दिए जाने वाले एक दिन के विज्ञापन रेट 70 लाख रुपए से बढ़ाकर 1.4 करोड़ रुपए करने की घोषणा की है।

बताया जाता है कि मंथली एक्टिव यूजर्स (MAUs) की संख्या में अप्रत्याशित वृद्धि के बाद यूट्यूब ने यह कदम उठाया है। आंकड़ों के अनुसार, यूट्यूब के मंथली एक्टिव यूजर्स 250 मिलियन, फेसबुक के 220 मिलियन और इंस्टाग्राम के 68 मिलियन हो चुके हैं, जबकि ट्विटर की बात करें तो यह आंकड़ा 30.4 मिलियन तक पहुंच चुका है। रिपोर्ट के अनुसार, यूट्यूब के बाद अब फेसबुक और ट्विटर भी अपनी विज्ञापन दरें बढ़ा रहे हैं।

विशेषज्ञों के हवाले से अखबार ने कहा है कि वर्ष 2019 में भी फेसबुक, ट्विटर और इंस्टाग्राम अपनी विज्ञापन दरों में सालाना 20 से 30 प्रतिशत की बढ़ोतरी करना जारी रखेंगे, क्योंकि हर साल इन प्लेटफॉर्म्स पर यूजर्स पहले के मुकाबले ज्यादा समय बिताने लग जाते हैं। हालांकि, फेसबुक ने विज्ञापन की दरों में बढ़ोतरी से इनकार किया है।
