Defence deals can be made public by stepping in Apex Court !!!


 

The Supreme Court will be hearing a petition seeking a stay on the Dassault Rafale fighter jet deal between India with France on the ground that there were discrepancies in the deal.

The plea, which will be heard next week, has been moved by advocate Manohar Lal Sharma who has alleged that there are gross irregularities in the deal for the purchase of 36 fighter jets inked between India and France on 23 September 2016.

A bench comprising Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud considered the advocate Sharma’s appeal that his plea be listed for urgent hearing.

According to reports, the petitioner has stated that the cancellation of the older tender without reason and the new deal getting inked without parliamentary approval suggest conspiracy.

Sharma has also sought an inquiry by a Special Investigation Team (SIT) monitored by the Supreme Court.

The Congress has been accusing the Bharatiya Janata Party (BJP)-led NDA government at the Centre over the pricing of the fighter jets. The Congress claims that the deal inked during the UPA rule was Rs 520 crore per aircraft which ballooned to Rs 1,600 crore in the new deal under the NDA regime.

Led by its president Rahul Gandhi, the party has demanded that the government reveal the price details of the Rafale fighter jets.

Recently, the Congress also attacked the government and Anil Ambani-led Reliance Group over the deal. Dassault entered into a joint-venture with the Reliance Group to fulfil the offset requirement of the deal.

Ambani had in August sent legal notices to several Congress leaders and also told Rahul Gandhi in a letter that his party has been “misinformed, misdirected and misled” by “malicious vested interests and corporate rivals” on the issue.

In its defence, the government has said that it is bound by a “secrecy clause” that was signed in 2008 during the UPA years which prohibits both New Delhi and Paris from revealing details of the deal to the public.

In his address during the debate on no-confidence motion in Lok Sabha in July, Gandhi said the French president Emmanuel Macron had clearly conveyed to him that there was no problem in sharing details relating to the Rafale contrary to what the government has been saying and that the “Defence Minister (Nirmala Sitharaman) has clearly spoken an untruth” about there being a secrecy pact.

However, a statement issued by the French government apparently punctured the Congress president’s claim.

“We have noted the statement of Mr Rahul Gandhi before the Indian Parliament. France and India concluded in 2008 a security agreement, which legally binds the two States to protect the classified information provided by the partner, that could impact security and operational capabilities of the defence equipment of India or France,” the Spokesperson of the Ministry of Europe and Foreign Affairs said.

Yug Gupta murder case: ‘Death Penalty’ to all three convicts

Holding the case as rarest of the rare, Sessions Judge Virender Singh pronounced the verdict at 2 pm amidst tight security.


All three accused in the Yug Gupta murder case were sentenced to death by a District and Sessions Court on Wednesday.

Chander Sharma (26), Tajender Pal Singh (29) and Vikrant Bakshi (22) have been held guilty of kidnapping, murder and conspiracy in connection with the death of 4-year-old Yug Gupta in Shimla in 2014.

Holding the case as rarest of the rare, Sessions Judge Virender Singh pronounced the verdict at 2 pm amidst tight security.

All three accused were convicted by the court on 6 August. The court had fixed the date for pronouncing quantum of sentence on 29 August, eight days after recording the statements of the parents of the accused.

Later, the court deferred the date of pronouncing the quantum of sentence to 5 September.

Justice Singh said that the execution of sentence shall be subject to the confirmation from High Court of Himachal Pradesh.

The Judge also told the accused, who were present in the court, that they can file an appeal before the High Court within a period of 30 days from today. A fine of Rs 50,000 also imposed on all the three accused.

The teary-eyed parents and grandmother of Yug Gupta heaved a sigh of relief as the Judge pronounced the punishment.

Yug’s father Vinod Gupta said that justice has been finally delivered.

“Though my son is not alive anymore, the court has done justice,” he said.

Yug’s mother, Pinki Gupta, broke down as she heard the judgment. “My son has got justice and I am relieved,” she said.

Calling it “a landmark”, District Attorney RS Parmar said that the judgment restored the faith of the people in rule of law.

Yug Gupta was kidnapped from outside his house in Ram Bazaar in Shimla on 14 June 2014 by his neighbour Chander Sharma, who lured him with chocolates.

The accused had kept the boy naked, tortured him and forced him to consume liquor for seven days. He was later dumped alive in water storage tank seven days after the abduction, even before the first ransom call was made to his parents.

The accused allegedly sent a letter demanding ransom from the child’s father on 27 June, six days after they had killed the boy.

Two years after the Shimla Police failed to make any headway, the case was handed over to CID who recovered the minor boy’s skeletal remains from the Shimla Municipal Corporation’s water storage tank in Kelston area on 21 August 2016.

On 22 August 2016, the police arrested Sharma, Singh and Bakshi and booked them under sections 302, 201, 342, 364 A and 120 B of the Indian Penal Code.

Police investigations had revealed that Chander had even taken part in protests and search for child to avoid suspicion. And he was the one who had insisted on killing the boy as the child knew him while Tejender and Vikrant were opposed to the idea.

Former Gujarat IPS officer Sanjiv Bhatt arrested in 22-year-old narcotics case


The Congress has come out in support of the former IPS officer alleging that the arrest is an example of “undeclared emergency”.

The Crime Investigation Department of the Gujarat Police arrested sacked IPS officer Sanjiv Bhatt in connection with the 1998 Palanpur drug planting case.

Bhatt, who was dismissed by the Union Ministry of Home Affairs in August 2015 for “unauthorised absence” from service, was among eight former policemen detained by the CID for questioning.

Bhatt and seven others, including some former policemen attached with the Banaskatha police, were earlier in the day detained for questioning in the case, Director General of Police, Crime Investigation Department (CID), Ashish Bhatia said.

The 22-year-old case relates to the arrest of a man for alleged possession of drugs by Banaskatha Police. Bhatt was the Banaskantha district superintendent of police in 1996. The other cops, too, were associated with the Banaskantha Police force.

According to reports, the arrested man, an advocate called Sumersingh Rajpurohit, was charged for possessing around 1 kg of drugs. At that time, the Banaskanta police had claimed that the drugs were found in a hotel room occupied by Rajpurohit in the district’s Palanpur town.

However, an investigation by the Rajasthan Police had revealed that Rajpurohit was falsely implicated by the Banaskatha police. It had also found that Rajpurohit was allegedly kidnapped by the Banaskatha police from his residence at Pali in Rajasthan.

The Gujarat High Court had in June this year handed over the probe to the CID setting a deadline of three months.

Reports say that interrogation of Sanjiv Bhatt and the seven others is under way.

The Congress dubbed the arrest a case of “kangaroo justice BJP style” and an example of an “undeclared emergency”.

“For an alleged case dating back to 1998 @sanjivbhatt detained/ arrested in 2018. Kangaroo justice BJP style. Looks to be a desperate act of vendetta to settle old scores now with less than 6 months of the Government’s tenure left. Dono Bhai  Lage Hua Hain #undeclaredemergency,” wrote Congress spokesperson Manish Tewari on Twitter.

Administrator UT Chandigarh V P Badnore has  directed Chandigarh  Traffic Police to halt the challan campaign of Sikh women driving bikes without helmets for more fifteen days.

The decision to postpone the challan campaign was taken after a delegation of protesting Sikhs met Mr Badnore today. Now the Chandigarh Traffic police will continue awareness campaign for more two weeks .

Earlier , the Sikh organisations stage a protest demonstration against the decision of the Chandigarh administration to enforce the wearing of helmet mandatory for non-turbaned Sikh women driving bikes without helmet . Traffic police had announced to start challan campaign from today.

MC Panchkula granted 3 weeks time to reply cattle menance

PANCHKULA, September 5:

The Court of Sh. Kanwal Kumar, ACS (SD) today granted 3 weeks time to the Commissioner, Municipal Corporation and Deputy Commissioner Panchkula to reply and file an action taken report on the stray cattle menace in Panchkula in response to the PIL filed by Advocate Pankaj Chandgothia, after advocate Anil Garg appeared on their behalf and sought time to file reply. The Court also issued urgent DASTI notices to the Chief Secretary Haryana; Director, Urban Local bodies, Haryana and Director General of police Haryana as no counsel appeared on their behalf today, inspite of their having received the notice in the case. Dasti notices have been issued for 26th September, 2018.
In his petition filed under Section 91 of Civil Procedure Code, Chandgothia has termed the stray cattle menace as a public nuisance. He said that the commuting public in Panchkula is in constant danger and risk of meeting with accidents due to various deficiencies and negligence on the part of the defendants, who all are liable to ensure the safety and welfare of the citizens. Stray Cattle are often found sitting or moving in the middle of busy roads, leading to sudden breaking by vehicles, giving rise to the risk of accidents and resultantly injuries and loss of life and also damage to vehicles. This malaise has been highlighted by the print media many times, but the concerned authorities are turning a blind eye to the grave problem.

Chandgothia contended that there is no proper agency nor co-ordination between the various functionaries to strictly deal with the problem of stray cattle menace in the city. A special cell needs to be created with representatives from all concerned department including the administration, municipal council/corporation and police, in order to deal with this problem. The stray cattle must be immediately removed from the streets/roads/public places and a scheme needs to put in place to prevent them from coming on to roads and public spaces, to ensure the safety of the general public.

It is pointed out that the authorities can also take penal action and register FIRs against the guilty persons under Section 268, 283, 289 and 290 and 291 of IPC. In addition, criminal action can also be taken under sections 337 and 338 of IPC.

Chandgothia has also sought a compensation policy wherein the administration should be held liable to compensate any person who suffers on account of the stray cattle menace. The police must register an FIR in every such case.

सवर्ण जातियों का विरोध झेलतीं राजनैतिक पार्टियां


अब सवर्णों की पार्टी कही जाने वाली बीजेपी को सवर्णों की नाराजगी झेलनी पड़ रही है. हिंदी भाषी राज्यों में अपनी जड़े जमाने वाली बीजेपी इस तबके के वोटरों को लेकर सशंकित भी है और चिंतित भी


एससी-एसटी एक्ट में संशोधन कर सुप्रीम कोर्ट के फैसले को पलटने वाले सरकार के कदम का विरोध तेज हो रहा है. मध्यप्रदेश के ग्वालियर के फूलबाग मैदान में जुटे करीब दर्जन भर संगठनों की तरफ से इस मुद्दे पर हल्लाबोल शुरू किया गया है. मध्यप्रदेश में सवर्ण संगठनों ने विरोध ज्यादा तेज कर दिया है.

क्षत्रिय महासभा, गुर्जर महासभा, परशुराम सेना जैसे सवर्ण जातियों का प्रतिनिधित्व करने वाले संगठनों की ओर से विरोध का बिगुल फूंका गया है. 6 सितंबर को इस मुद्दे पर भारत बंद का आह्वान भी किया जा रहा है. इनकी नाराजगी बीजेपी और कांग्रेस दोनों के खिलाफ है. लेकिन, निशाने पर बीजेपी के नेता और केंद्र और राज्य सरकार के मंत्री ज्यादा हैं. क्योंकि सरकार बीजेपी की ही है.

क्या था सुप्रीम कोर्ट का फैसला: 

सुप्रीम कोर्ट ने अपने फैसले में कहा था कि एससी-एसटी एक्ट से जुड़े मामले में किसी भी व्यक्ति पर मुकदमा दर्ज होने से पहले उस पर आरोपों की जांच की जाएगी. इसी के बाद देशभर में एसएसी-एसटी तबके की तरफ से विरोध तेज हो गया था. कांग्रेस समेत कई विपक्षी दलों और बीजेपी के सहयोगी दलों की तरफ से भी इस मुद्दे पर सरकार से हस्तक्षेप की मांग की गई थी.

राजनीतिक दबाव में केंद्र की बीजेपी सरकार ने इस मामले में संसद के मॉनसून सत्र में कानून पास कराकर सुप्रीम कोर्ट के फैसले को पलट दिया. अब एक बार फिर से पुराने ढर्रे पर ही एससी-एसटी कानून के तहत कार्रवाई का मार्ग प्रशस्त हो गया है. यानी इस एक्ट में फिर से बिना जांच के भी मुकदमा दायर करने और गिरफ्तारी का रास्ता साफ हो गया है.

एससी-एसटी संगठनों ने सुप्रीम कोर्ट के फैसले का विरोध करते हुए पिछले 2 अप्रैल को भारत बंद का आह्वान किया था, जिसमें काफी हिंसक झड़पें भी हुई थीं. मध्यप्रदेश समेत देश भर में बंद का असर भी दिखा था. सरकार को लगा कि इस तबके को मनाने और विरोधियों का मुंह बंद करने के लिए सुप्रीम कोर्ट के फैसले को पलटने वाला कानून पास कराना होगा. सरकार ने ऐसा  कर भी दिया. लेकिन, अब यह मुद्दा उसके गले की हड्डी बनता जा रहा है.

बीजेपी के खिलाफ सवर्ण हो रहे लामबंद:

अब सवर्ण संगठनों का विरोध सरकार और बीजेपी के लिए परेशानी का कारण बनता जा रहा है. सबसे ज्यादा विरोध मध्यप्रदेश में दिख रहा है, जहां, दो महीने के भीतर विधानसभा का चुनाव होना है. मुख्यमंत्री शिवराज सिंह चौहान इस वक्त राज्य भर का दौरा कर रहे हैं. लेकिन, उन्हें भारी विरोध का सामना करना पड़ रहा है. बीजेपी नेता प्रभात झा, नरेंद्र सिंह तोमर जैसे कई दूसरे नेताओं को भी सवर्ण संगठनों की तरफ से घेरा जा रहा है. उनसे जवाब मांगा जा रहा है. लेकिन, बीजेपी के इन सवर्ण नेताओं के लिए उन्हें समझा पाना मुश्किल हो रहा है.

विरोध की आग मध्यप्रदेश से आगे भी पहुंच रही है. बिहार और यूपी समेत दूसरे प्रदेशों में एससी-एसटी एक्ट के मुद्दे पर विरोध हो रहा है. बिहार के बेगूसराय, गया, नालंदा और बाढ़ जिलों में सवर्ण संगठनों ने बंद भी बुलाया. कई जगह पर नेशनल हाईवे भी जाम किया और जमकर विरोध किया.

विरोध बीजेपी और कांग्रेस दोनों के खिलाफ दिख रहा है. लेकिन, इससे सबसे ज्यादा नुकसान बीजेपी को होता दिख रहा है. इन सवर्ण संगठनों की तरफ से विरोध के क्रम में अगले चुनाव में नोटा दबाने की अपील की जा रही है. इनकी तरफ से बार-बार यही कहा जा रहा है कि नोटा के जरिए हम बीजेपी और कांग्रेस दोनों का विरोध करेंगे.

दरअसल, बीजेपी को अबतक सवर्णों की पार्टी कहा जाता रहा है. ब्राम्हण –बनिया की पार्टी कही जाने वाली बीजेपी ने धीरे-धीरे समाज के हर तबके में अपना विस्तार भी किया है. पिछड़ी-अतिपिछड़ी जातियों के अलावा, एससी-एसटी तबके में भी बीजेपी का जनाधार पहले से कहीं ज्यादा बेहतर हुआ है. खासतौर से 2014 के लोकसभा चुनाव में मोदी लहर में कास्ट बैरियर टूट जाने के बाद बीजेपी के वोट शेयर में जबरदस्त इजाफा हुआ. अपने दम पर बीजेपी पहली बार सत्ता में आई.

लोकसभा में कितने हैं एससी-एसटी सांसद?

यहां तक कि लोकसभा में एससी-एसटी सांसदों के लिए आरक्षित सीटों की संख्या 131 है. जिसमें 84 एससी और 47 एसटी सांसदों की संख्या है. मौजूदा वक्त में बीजेपी के पास इस तबके के 67 सांसद हैं. ऐसे में बीजेपी किसी भी कीमत पर इस तबके की नाराजगी नहीं मोल लेना चाह रही थी. यही वजह है कि सुप्रीम कोर्ट के फैसले को पलटने का फैसला किया गया.

लेकिन, अब सवर्णों की पार्टी कही जाने वाली बीजेपी को सवर्णों की नाराजगी झेलनी पड़ रही है. हिंदी भाषी राज्यों में अपनी जड़े जमाने वाली बीजेपी इस तबके के वोटरों को लेकर सशंकित भी है और चिंतित भी. तभी तो पार्टी नेताओं और मुख्यमंत्रियों को सवर्ण तबके को समझाने की जिम्मेदारी दी गई है कि आखिर यह फैसला क्यों करना पड़ा.

वजह जो भी हो, लेकिन, सवर्ण मतदाताओं के भीतर अब यह बात घर कर गई है कि एससी-एसटी तबके को साधने के लिए सरकार ने उनके साथ अन्याय किया है. अब इस बात को लेकर उनका विरोध शुरू हो गया है. मंडल कमीशन लागू होने के बाद शायद यह पहला मौका है कि सवर्ण तबका भी अब खुलकर अपनी बात कर रहा है. चुनावी साल में राजनीतिक दल परेशान हैं. बीजेपी डरी है कहीं यह नाराजगी उस पर भारी न पड़ जाए ?
